Claim Rejections - 35 USC § 112
The following is a quotation of 35 U.S.C. 112(b):
(b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention.
The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph:
The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention.
Claims 1-3 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention.
Regarding claims 1-3, the claimed limitations, “creating a combined pre-distorted component by combining each of a plurality of pre-distorted polyphase components, wherein each of the plurality of pre-distorted polyphase components are single phase dependent; feeding the combined pre-distorted component to an output filter to form a pre-distorted transmission signal; and generating an output signal by applying the pre-distorted transmission signal to the power amplifier to generate an output signal”, render the claims indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention. As depicted in Fig. 1, the combination of the plurality of pre-distorted polyphase components of the transmission signals are being create at the summation 125 to form the combined pre-distorted transmission signal (see fig. 1, 127 y(k)) and wherein the combined pre-distorted transmission signal inputs to the power amplifier 135. Likewise with FIG. 2, the combination of the plurality of pre-distorted polyphase components of the transmission signals are being create at the summations (+) to form the combined pre-distorted transmission signal (fig. 2, 225 y(n)). Its appears in claims 1-3, that the creation of the combined pre-distorted transmission signal (see fig. 1, 127 y(k) and fig. 2, 225 y(n)) are being created prior to the summation 125 (see fig. 1) or the summations (+) (see fig. 2). Therefore, appropriate correction required.
