19DETAILED ACTION Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . Examiner feels that claims 19-21 should depend on claim 2 or 10 instead of claim 3. Claim Rejections - 35 USC § 102 The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action: A person shall be entitled to a patent unless – (a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention. Claims 1 are rejected under 35 U.S.C. 102(a)(1) as being anticipated by Islam (US 2017/0289966). . Claims 1-10 and 12-21 are rejected under 35 U.S.C. 103 as being unpatentable over Cheng (US 2023/0188277) in view of Harada (US 2022/0330239). Regarding claims 1-2 and 10, Islam describes a radio node/method of operating a radio node in a wireless communication network/non-transitory computer storage medium storing a computer program comprising instructions causing processing circuitry to one or both control and perform a method (para. 10-12, a base station as a method, apparatus, or computer-readable medium), comprising: communicating utilising data signaling carrying a data block having a data block size, the data signaling starting in a time domain at a starting allocation unit, the data block size being dependent on a position in a time domain of a reference allocation unit associated to reference signaling, the reference allocation unit trailing starting allocation unit in a time domain (fig. 2A & para. 49, for specifying a downlink (DL) frame 200 content comprising 2 time-slot subframes in the time domain & represented by a resource grid holding resource blocks & resource elements (data block) of data), base station uses PDCCH to indicate downlink resources for the PDSCH, by signaling to UE the start symbol index (starting allocation unit) of range [0, 3] and a stop symbol index of range [10, 13] (reference allocation unit that will trail starting allocation unit), thereby yielding number of symbols carried in a subframe being 14 (block size), see para. 70). Regarding claims 3 and 12, Islam describes: wherein the data block corresponds to one or both of a code block bundle and a code block (para. 49, resource blocks (RBs) representing the data block = code block). Regarding claims 4, 13 and 19, Islam describes: wherein to the data signaling, there is associated Demodulation Reference Signaling (DMRS) carried on an allocation unit preceding the data signaling in time domain (para. 70, base station uses PDCCH to signal indication that it will transmit a DMRS with a first DCI message (allocation unit) before (preceding) data transmission (signaling) in the downlink). Regarding claims 5, 14 and 20, Islam describes: wherein communicating utilises multiple data signalings, each having data blocks of the same data block size (para. 49, the downlink (DL) data transmission (signalings) of frames comprises equally sized subframes (data blocks of same block size)). Regarding claims 6, 15 and 21, Islam describes: wherein the data signaling comprises control information preceding the data block in the time domain (fig. 6, time-domain based PDSCH frame structure for data transmission (signaling) in PDSCH comprises preceding PDCCH (control information)). Regarding claims 7 and 16, Islam describes: wherein the reference signaling is Demodulation Reference Signaling, DMRS, associated to one or both second data signaling and control signaling (para. 70, base station uses PDCCH (control signaling) to signal indication that it will transmit a reference signaling being a DMRS). Regarding claims 8 and 17, Islam describes: wherein the reference allocation units occur periodically (para. 3, method in disclosure is performed in a periodicity (periodically), para. 64). Regarding claims 9 and 18, Islam describes: wherein, for multiple data signaling occurrences, each data block is associated to a different one or both of an acknowledgement signaling process and a signaling process range. (para. 50 & 59, the downlink (DL) data transmission (signaling) comprising resource blocks/resource elements (data block) is associated with HARQ (acknowledgement signaling process)). Conclusion Applicant's amendment necessitated the new ground(s) of rejection presented in this Office action. Accordingly, THIS ACTION IS MADE FINAL. See MPEP § 706.07(a). Applicant is reminded of the extension of time policy as set forth in 37 CFR 1.136(a). A shortened statutory period for reply to this final action is set to expire THREE MONTHS from the mailing date of this action. In the event a first reply is filed within TWO MONTHS of the mailing date of this final action and the advisory action is not mailed until after the end of the THREE-MONTH shortened statutory period, then the shortened statutory period will expire on the date the advisory action is mailed, and any nonprovisional extension fee (37 CFR 1.17(a)) pursuant to 37 CFR 1.136(a) will be calculated from the mailing date of the advisory action. In no event, however, will the statutory period for reply expire later than SIX MONTHS from the mailing date of this final action.
