Claim Rejections - 35 USC § 112
5. The following is a quotation of 35 U.S.C. 112(b):
(b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention.
The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph:
The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention.
6. Claims 6-13 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention.
7. Claim 6 recites the limitation “all the second expansion compartment” in line 5. Only a second expansion compartment is recited, therefore there is insufficient antecedent basis for this limitation in the claim.
8. Claims 8-13 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being incomplete for omitting essential structural cooperative relationships of elements, such omission amounting to a gap between the necessary structural connections. See MPEP § 2172.01.
The omitted structural cooperative relationships are:
Re Claim 8 recites “the expansion compartment” in line 4, however it is unclear which expansion compartment this is referring to.
Re Claim 10: lines 3-4 recites, “charging chamber closing to the battery swapping chamber”. Specifically “closing” is unclear.
Allowable Subject Matter
9. Claims 1-5 and 14-20 are allowable over prior art.
The following is an examiner’s reason for allowance: Although prior art includes teachings of battery swapping stations, wherein the station comprises a swapping chamber used for battery replacement for an electric vehicle and charging chamber, the identified prior art of record, taken alone, or in combination with any other prior art, fails to teach or fairly suggest the specific features of claims 1-5 and 14-20 of the present claimed invention. Specifically, prior art fails to teach the claimed battery swapping station, comprising: a battery swapping chamber used for battery replacement for an electric vehicle; charging chambers, wherein the charging chambers are located on both left and right sides of a vehicle parking position in the battery swapping chamber and used for charging and discharging batteries; a first expansion compartment, wherein the first expansion compartment is located above the battery swapping chamber, and the first expansion compartment is provided with an extension end that extends from above the battery swapping chamber in a running direction of the electric vehicle. The above limitations are not disclosed in prior art and moreover, one of ordinary skill in the art would not have been motivated to come to the claimed invention.
