Claim Rejections - 35 USC § 112
The following is a quotation of 35 U.S.C. 112(b):
(b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention.
The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph:
The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention.
Claims 1-8 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention.
Claims 1 recites the limitation ".. the motor comprises…" in line 2. There is insufficient antecedent basis for this limitation the motor in the claim. It is not clear to the examiner whether applicant is addressing assemblable modular and disc coreless permanent magnet superconducting ultra-efficient motor or N-pole motor. Hence, claim 1 and depending claims 2-8 are rejected on the basis of indefiniteness. Appropriate correction is needed.
Claims 2-8 recites “An assemblable modular and disc coreless permanent magnet superconducting ultra-efficient motor as claimed in claim 1, ….” in the pre amble. It is not clear to the examiner whether applicant is referring to the claim 1 preamble or a separate motor. Hence, claims 2-8 are rejected. Examiner suggest to replace the term “An assemblable modular and disc coreless permanent magnet superconducting ultra-efficient motor” with “The [[An]] assemblable modular and disc coreless permanent magnet superconducting ultra-efficient motor” in claims 2-8.
Conclusion
Claims 1-8 are rejected.
