Election/Restrictions
Applicant’s election without traverse of species SEQ ID NOs: 25 and 19, GLP1 SEQ ID NO: 232 and FGF21 SEQ ID NO: 234 in the reply filed on 7/16/2026 are acknowledged. After further consideration the species election is hereby withdrawn, and all species will be examined.
Claims 102-121 are pending and will be examined on the merits.
Claim Rejections - 35 USC § 102
The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action:
A person shall be entitled to a patent unless –
(a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention.
Claims 102, 105-107, 109-113 are rejected under 35 U.S.C. 102(a)(1) as being anticipated by Boettcher et al. (WO/2013/049234, published 4/4/2013).
The Claims are drawn to an immunoglobulin fusion protein comprising an antibody variable domain region, a first extender fusion region comprising a GLP1 peptide and a second extender fusion region comprising an FGF21 peptide and a linker peptide.
Boettcher et al. teach a dual function fusion protein comprising a GLP-1 receptor agonist region and an FGF21 receptor agonist region (see claim 1). Boettcher et al. further disclose “the GLP-1 receptor agonist is fused to the N-terminus of heavy and light chain of an antibody and FGF21 is simultaneously fused to the C-terminus of heavy and light chain of the same antibody (i.e., a fusobody, as described herein)” (see paragraph [00023]). Boettcher et al. teach GLP-1 and FGF21 sequences having 90% identity to instantly claimed SEQ ID NOs: 228, 232, and 234 as well as linkers having instantly claimed SEQ ID NOs: 179 and 180 (see table 1 and paragraph [000286]).
Conclusion
Claims 102, 105-107, 109-113 are rejected.
Claims 103, 104, 108, 114-117 are objected to as being dependent upon a rejected base claim, but would be allowable if rewritten in independent form including all of the limitations of the base claim and any intervening claims.
Claims 118-121 are allowable.
