DETAILED ACTION Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . Status of Claims Claims 1-19 are pending in this application. Election/Restrictions Applicant’s election without traverse of Group I (Claims 9-19) in the reply filed on 12/15/25 is acknowledged. Claims 1-8 are withdrawn from further consideration pursuant to 37 CFR 1.142(b) as being drawn to nonelected inventions, there being no allowable generic or linking claim. Claims 9-19 are examined in this Office action. Foreign Priority Receipt is acknowledged of certified copies of papers submitted under 35 U.S.C. 119(a)-(d), which papers have been placed of record in the file. Information Disclosure Statement Acknowledgment is made that the information disclosure statement has been received and considered by the examiner. If the applicant is aware of any prior art or any other co-pending applications not already of record, he/she is reminded of his/her duty under 37 CFR 1.56 to disclose the same. Drawings There are no objections or rejections to the drawings. Specification The title of the invention is not descriptive. A new title is required that is clearly indicative of the invention to which the claims are directed. The lengthy specification has not been checked to the extent necessary to determine the presence of all possible minor errors. Applicant's cooperation is requested in correcting any errors of which applicant may become aware in the specification. Claim Rejections - 35 USC § 112 The following is a quotation of 35 U.S.C. 112(b): (b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention. Claims 9-19 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor, or for pre-AIA the applicant regards as the invention. Claim 9 recites the limitation “forming, over the first memory layer, a first spacer layer extending in a third direction having a first angle tiled with respect to a second direction crossing the first direction;”. It is unclear what is meant by a third direction having a first angle tiled with respect to a second direction crossing the first direction. One reasonable interpretation is that the first angle tiled with respect to a second direction crossing the first direction. Another reasonable interpretation is that the there is a typographical error and the applicant intended to recite first angle tilted with respect to a second direction crossing the first direction. The Examiner cannot determine the intent since the specification recites both tiled and tilted, indicating both ambiguity and intentionality. One of ordinary skill in the relevant art would not know what structures/steps are covered by the limitation. For these reasons, the claim is indefinite. Claims 10-19 depend from rejected claim 9, include all limitations of claim 9 and therefore are rejected for the same reason. Allowable Subject Matter Claims 9-19 would be allowable if rewritten or amended to overcome the rejection(s) under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), 2nd paragraph, set forth in this Office action.
