Office Action

§102
DETAILED ACTION Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . Claim Rejections - 35 USC § 102 In the event the determination of the status of the application as subject to AIA 35 U.S.C. 102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory basis (i.e., changing from AIA to pre-AIA ) for the rejection will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status. The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action: A person shall be entitled to a patent unless – (a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention. Claim(s) 1-20 is/are rejected under 35 U.S.C. 102(a)(1) as being anticipated by Gupta et al. (hereinafter “Gupta”, US Pat No. 2011/0231407). As per claim 1, Gupta disclosed a processor-implemented method (see at least fig. 3 and fig. 7), wherein the method comprising gathering metadata for two or more contacts in a contact list in a communication platform or in a profile associated with a user (see 0044, 0052, 0054, and 0064-0065); generating a base priority list (old priority list) comprising the two or more contacts based on the gathered metadata (see at least abstract, 0004, 0044, 0052, 0054, and 0064-0065); gathering progressive metadata for at least one contact in the base priority list and the user; identifying an activity of the user based on the progressive metadata for the user (see at least abstract, 0004, 0044, 0052, 0054, and 0064-0065); generating a modified priority list (new updated list) based on the base priority list, the activity, and the progressive metadata for the at least one contact (see at least abstract, 0004, 0044, 0052, 0054, and 0064-0065); and generating a graphical user interface, on a user device display screen, displaying the modified priority list (see 0032, 0041-0042, 0049-0050, 0052, and 0065). As per claims 2, 9, and 16, Gupta disclosed the progressive metadata comprises dynamic metadata that changes over a period of time due to a natural progression (see 0036. As per claims 3, 10, and 17, Gupta disclosed the progressive metadata is selected from a group consisting of social media connections, content of communications between the user and one or more contacts in the base priority list, an internet search history, location information, weather information, and audio captured by an audio capture device (see at least abstract, 0004, 0026, 0031-0036, 0044-0048, 0052-0058, the contacts lists may be managed dynamically and prioritized contact information provided to users based on information from different resources and weighting factors). As per claims 4, 11, and 18, Gupta disclosed the activity is currently engaged in or predicted to be engaged in by the user, and wherein the activity includes a user status in relation to an environment around the user (see 0028-0032, 0041). As per claims 5, 12, and 19, Gupta disclosed generating the base priority list is further based on a communication frequency, a communication length, and a predicted relationship between the user and each respective contact in the two or more contacts (see 0028-0032, 0041). As per claims 6, 13, and 20, Gupta disclosed the metadata for the two or more contacts in the contact list is selected from a group consisting of a date at which a contact was added to the contact list, communication time durations between the contact and the user, number of communications between the contact and the user, and a word length of a conversation between the contact and the user (see at least abstract, 0004, 0026, 0031-0036, 0044-0048, 0052-0058). As per claims 7 and 14, Gupta disclosed gathering the metadata further comprises integrating installations across two or more communication platforms and/or repositories (see 0027). As per claims 8 and 15, as rejected above in claim 1, Gupta further disclosed a computer system comprising one or more processors (see fig. 7, 702), one or more computer-readable memories (see fig. 7, 704 & 709), one or more computer-readable tangible storage medium (see fig. 7, 704 & 709), and program instructions (inherently) stored on at least one of the one or more tangible storage medium for execution by at least one of the one or more processors via at least one of the one or more memories.
