Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . Claim Rejections - 35 USC § 112 The following is a quotation of 35 U.S.C. 112(b): (b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention. The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph: The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention. Claims 1-14 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention. Claim 1 is rejected as being vague and indefinite when it recites “at least one functional layer between the first electrode and the second electrode, and comprising an amine compound represented by Formula 1“ (emphasis added); the scope of the protection sought is not clear. Claim 1 fails to particularly point out and distinctly claim the contents of the claimed light emitting element, i.e. that the amine compound of formula 1 is contained in the functional layer. Claim Objections Claims 14 and 22 are objected to because of the following informalities: some of the single vs double bonds in the rings are not clearly distinguishable. Appropriate correction is required. Allowable Subject Matter The amine compound of claims 15-22, as generally represented by the present formula 1 PNG media_image1.png 171 460 media_image1.png Greyscale is distinguished from that of the prior art of record by comprising a core represented by any one of PNG media_image2.png 158 204 media_image2.png Greyscale PNG media_image3.png 181 210 media_image3.png Greyscale or PNG media_image4.png 186 212 media_image4.png Greyscale . Claims 15-21 are allowed. Claim 22 would be allowable if rewitten to overcome the objection set forth in this office action. The display device of claims 23-25, characterized by comprising an amine compound of formula 1 are allowed. Claim 1 would be allowable if rewritten or amended to overcome the rejection(s) under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), 2nd paragraph, set forth in this Office action. Claims 2-13 are objected to as being dependent upon a rejected base claim, but would be allowable if rewritten in independent form including all of the limitations of the base claim and any intervening claims. Claim 14 is objected to as being dependent upon a rejected base claim, but would be allowable if rewritten in independent form including all of the limitations of the base claim and any intervening claims, and, if rewitten to overcome the objection set forth in this office action.
