Notice of Pre-AIA or AIA Status
The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA .
In the event the determination of the status of the application as subject to AIA 35 U.S.C. 102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory basis for the rejection will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status.
Claim Rejections - 35 USC § 112
The following is a quotation of 35 U.S.C. 112(b):
(b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention.
Claims 1-20 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor, or for pre-AIA the applicant regards as the invention.
Claim 1 recites “PDM(D1) is permanent dipole moment” in line 25, and further recite PDM(Hx) is a permanent dipole moment of an xth host in the first emission layer” in lines 28-29 and further recites “W(Hx) is a weight fraction of the xth host in the first emission layer” in line 30. However, claim 1 fails to recite the relationships among PDM(D1), PDM(Hx) and W(Hx). It is unclear to the examiner how to determine Expression 1 without knowing the relationship among these variables.
Claim 1 recites “PDM(D2) is permanent dipole moment” in line 26, and further recite PDM(Hy) is a permanent dipole moment of an yth host in the second emission layer” in line 34 and further recites “W(Hy) is a weight fraction of the yth host in the second emission layer” in line 35. However, claim 1 fails to recite the relationships among PDM(D1), PDM(Hy) and W(Hy). It is unclear to the examiner how to determine Expression 2 without knowing the relationship among these variables.
Claim 1 recites a black square after PDM(H1) in line 27 and PDM(H2) in line 32. It is unclear to the examiner what the black square represents.
Claims 2-20 are rejected for being depending on claim 1 and having the above issue incorporate into the claims.
