Office Action

§112
DETAILED ACTION Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . Attorney Docket Number: F23-0557US001/590387.586 Filling Date: 12/26/2023 Priority Date: 01/30/2023 Inventor: Kim et al Examiner: Bilkis Jahan DETAILED ACTION Claim Rejections - 35 USC § 112 1. The following is a quotation of 35 U.S.C. 112(b): (b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention. The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph: The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention. Claims 7 and 21 recite the limitation "the highest turn-on voltage" and "the lowest turn-on voltage" in lines 1-3. There is insufficient antecedent basis for this limitation in the claim. Allowable Subject Matter 2. Claims 1-6, 8-20 and 22 are allowed. 3. The following is an examiner’s statement of reasons for allowance: 4. The applied prior arts neither anticipate nor render the claimed subject matter obvious because they fail to teach the claimed light emitting display device, comprising: each of the first intermediate layer, the second intermediate layer, and the third intermediate layer includes a red light emitting layer, a green light emitting layer, and a blue light emitting layer in order on the first electrode, in which the blue light emitting layer of the first intermediate layer has a vertical phase higher than those of the blue light emitting layers of the second intermediate layer and the third intermediate layer in combination with all other limitations as recited in claim 1. 5. The applied prior arts neither anticipate nor render the claimed subject matter obvious because they fail to teach the claimed light emitting display device, comprising: each of the first intermediate layer, the second intermediate layer and the third intermediate layer includes a red light emitting layer, a green light emitting layer and a blue light emitting layer in order on the first electrode, in which the blue light emitting layer of the first intermediate layer has a vertical phase higher than those of the blue light emitting layers of the second intermediate layer and the third intermediate layer in combination with all other limitations as recited in claim 15. 6. The applied prior arts neither anticipate nor render the claimed subject matter obvious because they fail to teach the claimed light emitting display device, comprising: each of the first intermediate layer, the second intermediate layer and the third intermediate layer includes a red light emitting layer, a green light emitting layer and a blue light emitting layer in order on the first electrode, in which the blue light emitting layer of the first intermediate layer has a vertical phase higher than those of the blue light emitting layers of the second intermediate layer and the third intermediate layer in combination with all other limitations as recited in claim 16. 7. Any comments considered necessary by applicant must be submitted no later than the payment of the issue fee and, to avoid processing delays, should preferably accompany the issue fee. Such submissions should be clearly labeled “Comments on Statement of Reasons for Allowance.” Remark 8. Claims 7 and 21 will be allowable after 112 2nd rejection is being overcome. Conclusion 9.
