DETAILED ACTION
The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA .
Election/Restrictions
Applicant's election with traverse of Group II (claims 10-20) in the reply filed on 3/6/26 is acknowledged. The traversal is found persuasive, therefore the restriction requirement is withdrawn, and non-elected claims 1-9 (Group I) are being examined for patentability.
Claim Objections
Claims 1, 2, 5, 6, 8, 10, 11, and 14-18 are objected to because of the following informalities:
In claim 1, --a-- should be added after “measure” in line 8; “transistor” should be changed to --transistors-- throughout lines 16-20 and 23; --parameter-- should be added after “calibration” in line 22 (see paragraph 116 of the published application); and --the-- should be added before “current” in line 22.
In claim 2, “transistor where” should be changed to --transistors when-- in line 2.
In claim 5, “current” should be changed to --the current being-- in line 2.
In claim 6, “a rate of change of current and an” should be changed to --the rate of change of the current and the-- in lines 2-3.
In claim 8, “transistor” should be changed to --transistors-- in line 2.
In claim 10, --a-- should be added after “measure” in line 7 and after “during” in line 14; “transistor” should be changed to --transistors-- in lines 15, 16, and 18; “,” should be added after “measure” and after “signal” in line 15; --parameter-- should be added after “calibration” in line 17 (see paragraph 116 of the published application); and --the-- should be added before “current” in line 18.
In claim 11, --,-- should be added after “measure” and after “sensor” in line 8; “a” should be changed to --the-- in lines 8 and 9; --the-- should be added before “current” in lines 9 and 14; “transistor” should be changed to --transistors-- throughout lines 10, 11, and 13; “(S1-6)” should be deleted from line 10; and “DC supply voltage” should be changed to --first voltage supply-- in line 12.
In claim 14, --voltage-- should be added before “supplies” in line 2.
In claim 15, “converter, ADC” should be changed to --converter (ADC)-- in line 3; --the-- should be added before “current” in lines 8 and 10; --parameter-- should be added after “calibration” in line 9 (see paragraph 116 of the published application); and “transistor” should be changed to --transistors-- in line 11.
In claim 16, “a measure of current” should be changed to --the measure of the current-- in lines 3-4.
In claim 17, “a measurement of rate of change of current” should be changed to --the measurement of the rate of change of the current-- in line 2; and “(S1-6)” should be deleted from line 3.
In claim 18, “transistor (S1-6) is” should be change to --transistors are--.
Appropriate correction is required.
Claim Rejections - 35 USC § 112
The following is a quotation of 35 U.S.C. 112(b):
(b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention.
The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph:
The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention.
Claims 1-20 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention.
In claim 1, it is not clear how the step recited in lines 17-19 is used to calibrate recited in the step in lines 21-23 (there is no relationship between these two steps).
In claim 10, it is not clear how the step recited in lines 15-16 is used to calibrate recited in the step in lines 17-18 (there is no relationship between these two steps).
Claims 2-9 and 11-20 are rejected for being dependent on a rejected base claim.
Conclusion
