Claim Rejections - 35 USC § 112
The following is a quotation of 35 U.S.C. 112(b):
(b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention.
The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph:
The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention.
Claims rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention.
Claim 3 recites the limitation "the first conductive structure" in line 1. There is insufficient antecedent basis for this limitation in the claim. Claim 3 will be interpreted as “the first conductive region” for the purpose of examination in this Office Action.
Claim 8 recites the limitation "he first additional conductive region" in lines 4-5. There is insufficient antecedent basis for this limitation in the claim. Claim 8 will be interpreted as “the first conductive region” for the purpose of examination in this Office Action.
Claim 12 recites the limitation "the conductive portion" in line 1. There is insufficient antecedent basis for this limitation in the claim. Claim 12, depending from claim 1, will be interpreted as “a second portion” for the purpose of examination in this Office Action, due to the second portion as claimed in claim 1 including conductive material.
Claim 13 recites the limitation "the conductive portion " in line 2. There is insufficient antecedent basis for this limitation in the claim. Claim 13, depending from claim 1, will be interpreted as “a second portion” for the purpose of examination in this Office Action, due to the second portion as claimed in claim 1 including conductive material.
Claim Rejections - 35 USC § 102
In the event the determination of the status of the application as subject to AIA 35 U.S.C. 102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory basis (i.e., changing from AIA to pre-AIA ) for the rejection will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status.

Claim Rejections - 35 USC § 103
In the event the determination of the status of the application as subject to AIA 35 U.S.C. 102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory basis (i.e., changing from AIA to pre-AIA ) for the rejection will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status.
The following is a quotation of 35 U.S.C. 103 which forms the basis for all obviousness rejections set forth in this Office action:
A patent for a claimed invention may not be obtained, notwithstanding that the claimed invention is not identically disclosed as set forth in section 102, if the differences between the claimed invention and the prior art are such that the claimed invention as a whole would have been obvious before the effective filing date of the claimed invention to a person having ordinary skill in the art to which the claimed invention pertains. Patentability shall not be negated by the manner in which the invention was made.
Rejection Note: Italicized claim limitations indicate limitations that are not explicitly disclosed in the primary reference(s).
Claim(s) 12 and 13 are rejected under 35 U.S.C. 103 as being unpatentable over Karda et al. (US 20210066196) as applied to claim 1 above, and further in view of Takeguchi (US 20140367804).
Regarding claim 12, Takeguchi discloses the following claim limitations not disclosed by Karda, the apparatus of claim 1, wherein:
the conductive portion (interpreted as the second portion, per the 112 rejections above) includes at least one of titanium nitride and tungsten.
Takeguchi teaches a gate structure comprised of polysilicon, silicide, and tungsten, where the silicide layer comprises titanium nitride (para. 0006-0008).
It would be obvious to one of ordinary skill in the art before the effective filing date of the invention to modify Karda’s teachings with Takeguchi’s in order to reduce interface resistance and also reduce sheet resistance (abstract).
Regarding claim 13, Karda discloses the apparatus of claim 1, wherein:
the dielectric structure Fig. 7: 518F/B includes aluminum oxide (para. 0095),
the semiconductor material (of the first portion of claim 1) includes polysilicon (para. 0072), and
the conductive portion (interpreted as the second portion, per the 112 rejections above) includes at least one of titanium nitride and tungsten.
Takeguchi discloses the following claim limitations not disclosed by Karda:
the conductive portion (interpreted as the second portion, per the 112 rejections above) includes at least one of titanium nitride and tungsten.
