Claim Rejections - 35 USC § 102
The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action:
A person shall be entitled to a patent unless –
(a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention.
Claim 1, 15, 16, 42, and 43 are rejected under 35 U.S.C. 102(a)(1) as being anticipated by Su et al. (US 10,266,617).
Su et al. discloses a cationic copolymer having an aromatic structural unit shown below wherein R1 and R2 are H or CH3, R3 and R4 are hydrogen, R5, R6, and R7 are each C1-C2 alkyl, m is 1 to 4, and n is 1 to 3. An aromatic structural unit in which R1 and R2 are hydrogen, n is 1 and m is 2 corresponds to claimed structural unit 1A in which m, n, and p = 0, R22 and R23 are hydrogen, and R21 is a quaternary ammonium group of formula (1S) wherein s = 0 and R37 is methylene.

Subject of independent claims 2-4 is patentably distinct over cited reference and over prior art listed in Applicant’s PTO-1449. Claims 2-4 will be allowable upon appropriate amendment to overcome claim objections set forth in paragraphs 6 to 12. None of these references teaches the subject of claims 2-4. Dependent claims 5-10, 12, 13, 19, 26-32, 35, 36, 44, 51-57, and 60-64 are objected to as being dependent upon a rejected base claim but would be allowable if rewritten to overcome claim objections, supra, and if rewritten in independent form including all limitations of the base claim and any intervening claims.
Claims are not in condition for allowance.
Drawings
Figure 1A is objected to as failing to comply with 37 CFR 1.84(p)(5) because it includes the following reference characters not mentioned in the description: 10, 12, 14, 16, 18, 20, 22, 24, 26, and 28.
Figure 1B is objected to as failing to comply with 37 CFR 1.84(p)(5) because it includes the following reference characters not mentioned in the description: 30, 32, 34, 36, 38, 40, 46, and 48.
Corrected drawing sheets in compliance with 37 CFR 1.121(d), or amendment to the specification to add the reference character(s) in the description in compliance with 37 CFR 1.121(b) are required in reply to the Office action to avoid abandonment of the application. Any amended replacement drawing sheet should include all of the figures appearing on the immediate prior version of the sheet, even if only one figure is being amended. Each drawing sheet submitted after the filing date of an application must be labeled in the top margin as either “Replacement Sheet” or “New Sheet” pursuant to 37 CFR 1.121(d). If the changes are not accepted by the examiner, the applicant will be notified and informed of any required corrective action in the next Office action. The objection to the drawings will not be held in abeyance.
Any inquiry concerning this communication or earlier communications from the examiner should be directed to Rip A. Lee whose telephone number is (571)272-1104.
