DETAILED ACTION Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . Claim Rejections - 35 USC § 102 In the event the determination of the status of the application as subject to AIA 35 U.S.C. 102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory basis (i.e., changing from AIA to pre-AIA ) for the rejection will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status. The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action: A person shall be entitled to a patent unless – (a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention. Claims 1 and 18 are rejected under 35 U.S.C. 102(a)(1) as being anticipated by Kim et al, WO2022/0101126 (published on 01/13/2022, cited here as its English translation US2022/0115470 (corresponding to US12,324,312). In re Claim 1, Kim discloses a display device comprising: pixels PX disposed on a substrate BSL (Fig. 5), wherein each of the pixels PX includes: a first conductive layer (marked as 1Cl in Fig. A) including a first conductive pattern SCL in T1 (marked as 1CP in Fig. A), a second conductive pattern SCL in T2 (marked as 2CP in Fig. A), and a third conductive pattern right SCL (marked as 3CP in Fig. A) that are disposed on the substrate BSL to be spaced apart from each other; a first insulating layer GI and a second insulating layer ILD that are sequentially stacked on each other on the first conductive layer SCL; a second conductive layer (DE in T1, DE in T2; DVL) disposed on the second insulating layer ILD, the second conductive layer 2CL including a first power line (DE in T1), a second power line (DE in T2), and a connection pattern DVL, which are spaced apart from each other; a third insulating layer (a lower portion of PSV) and a fourth insulating layer (an upper portion of PSV) that are sequentially stacked on each other on the second conductive layer 2CL ; a third conductive layer 3CL (CNL1 ; CNL2) disposed on the fourth insulating layer (the upper portion of PSV), the third conductive layer 3CL including first alignment electrodes REL1 and second alignment electrodes REL2, which are spaced apart from each other; and a light emitting element LD1 disposed on the first REL1 and second REL2 alignment electrodes, and at least one of the first alignment electrodes (REL1, REL2) is electrically connected to at least one of the first conductive pattern 1CP, the second conductive pattern, and third conductive pattern (Figs. 1- 5 and A; [0044 – 0254]). Kim’s Fig. 5 annotated to show the details cited In re Claim 18, Kim discloses the display device of claim 1, wherein each of the first conductive pattern 1CP and the second conductive pattern 2CP is a floating pattern (Fig. A). Allowable Subject Matter Claims 2-17 and 19 are objected to as being dependent upon a rejected base claim, but would be allowable if rewritten in independent form including all of the limitations of the base claim and any intervening claims. Reason for indicating allowable subject matter In re Claim 2: The prior art of record cited by the current office action, alone or in combination, fail to anticipate or render obvious such limitation of claim 2 as: “a third via hole exposing the connection pattern”, in combination with limitations of Claim 1 on which it depends. In re Claim 19: The prior art of record cited by the current office action, alone or in combination, fail to anticipate or render obvious such limitation of claim 2 as: “a fourth conductive layer including a first electrode and a second electrode, which are disposed on the insulating pattern to be spaced apart from each other, and the first electrode is electrically connected to the first alignment electrode while penetrating the first contact hole, and the second electrode is electrically connected to the second alignment electrode while penetrating the second contact hole”, in combination with limitations of Claim 1 on which it depends. Allowable Subject Matter Claim 20 is allowed. The following is an examiner’s statement of reasons for allowance: In re Claim 20, prior-art fails to disclose a display device comprising “a third via hole exposing the connection pattern.” Therefore, the claimed device / method differs from prior art devices on this point and there is no evidence it would have been obvious to make this change.
