Claim Rejections - 35 USC § 102
In the event the determination of the status of the application as subject to AIA 35 U.S.C. 102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory basis (i.e., changing from AIA to pre-AIA ) for the rejection will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status.
The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action:
A person shall be entitled to a patent unless –
(a)(2) the claimed invention was described in a patent issued under section 151, or in an application for patent published or deemed published under section 122(b), in which the patent or application, as the case may be, names another inventor and was effectively filed before the effective filing date of the claimed invention.
Claim(s) 1-18 is/are rejected under 35 U.S.C. 102(a)(2) as being anticipated by Logvinov et al, WO 2018156732.
Regarding claims 1 and 13, Logvinov et al disclose a method and apparatus for charging a battery from an isolatable electric power grid comprising: acquiring information on energy supplied (the microgrid 202 identifies the EV 255 to obtain information; par. 0064-0067); processing information on the energy to establish an energy class of the energy (including processor 312, par. 0067); and assigning the energy that is delivered to the energy store to an energy class (the system determines which energy source to use microgrid 202 based on energy DER 218 or renewable 222, par. 0081).
Regarding claims 2 and 16, comprising: taking up an offset instruction; and altering the energy class of the energy delivered on a basis of the offset instruction (control information from the system controller 240 for controlling the output power, par. 0081).
Regarding claim 3, comprising: outputting information on the energy class of the energy delivered (the energy includes energy from the grid and renewable energy, par. 0080-0081).
Regarding claims 4 and 17, wherein the information on the energy includes a CO2 footprint of the energy (the determine the lowest possible cost and lowest carbon footprint, par. 0103).
Regarding claims 5 and 18, comprising: outputting control commands on a basis of the energy class of the energy delivered (the system controller 240 receives instruction to operate each class of energy, including grid and renewable, par. 0080-0081).
Regarding claim 6, Logvinov et al disclose a method and apparatus for charging a battery from an isolatable electric power grid comprising: an input terminal for the take-up of energy from an energy source (such as wiring 30 and powerline 214, par. 0064); an output terminal for relaying the energy to an energy store power (interface 232, par. 0064); and a control unit configured to: control a flux of the energy; acquire information on the energy supplied; process information on the energy to establish an energy class of the energy (including power system controller 240 and charging controller 230, par. 0064); and assign the energy that is delivered to the energy store to an energy class (the energy class can be energy from the grid 202, storage system 220, or the renewable energy 222). (See Fig. 3, par. 0062+).
Regarding claim 7, wherein the charging device is configured for bidirectional relaying of energy (an identified EV can supply power to or consume power from microgrid 202, par. 0065).
Regarding claim 8, wherein the control unit is configured to: control a relaying of energy on a basis of the information regarding the energy (the microgrid 202 identifies the EV 255 to obtain information; par. 0064-0067).
Regarding claim 9, wherein the control unit is configured to: take up an offset instruction; and alter the energy class of the energy delivered on a basis of the offset instruction (control information from the system controller 240 for controlling the output power, par. 0081).
Regarding claim 10, wherein the control unit is configured to: output information on the energy class of the energy delivered (the energy includes energy from the grid and renewable energy, par. 0080-0081).
Regarding claim 11, wherein the information on the energy includes a CO2 footprint of the energy (the determine the lowest possible cost and lowest carbon footprint, par. 0103).
Regarding claim 12, wherein the control unit is configured to: output control commands on a basis of the energy class of the energy delivered (the system controller 240 receives instruction to operate each class of energy, including grid and renewable, par. 0080-0081).
Regarding claim 14, wherein the control unit is configured to: control the vehicle on a basis of the energy class of the energy delivered to the energy store (the control unit can obtain power related data and other data to control charging of an EV battery, par. 0086).
Regarding claim 15, wherein the control unit is configured to: deliver an output of the energy class of the energy delivered to the energy store to a user of the vehicle (the energy delivered maybe based on user profile or preference, par. 0058, 0085).
Conclusion
The prior art made of record and not relied upon is considered pertinent to applicant's disclosure. Uyeki et al, US Patent No. 11,315,199, disclose a system and method for providing OEM control to maximize profits.
