Claim Rejections - 35 USC § 102
The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action:
A person shall be entitled to a patent unless –
(a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention.
Claims 14, 16 and 18 are rejected under 35 U.S.C. 102(a)(1) as being anticipated by Girard Desprolet et al. ( Girard Desprolet, US 2015/0155319 A1).
Regarding claim 14, Girard Desprolet shows an electronic device, comprising: a first assembly layer ( FIL 1 in FIG. 5) that includes: a first copper region ([0049]) having a first surface (see FIG. 6); a second assembly layer ( FIL2 in FIG. 6) having a second surface hybrid bonded ( dotted line in FIG. 6) to the first surface, the second assembly layer including: a second region of oxide ( RDl1 and [0049] i.e. made of dielectric) or of an oxidized metal, wherein the entire first copper region is in contact with the oxide or the oxidized metal of the second region (see FIG. 6).
Regarding claim 16, Girard Desprolet shows an electronic device, comprising, wherein the oxide or the oxidized metal comprises a silicon oxide, a silicon oxynitride, a silicon oxycarbide, or an oxidized amorphous silicon ([0014]).
Regarding claim 18, Girard Desprolet shows an electronic device, comprising: a filter having an optical Fabry-Perot cavity ( CV1 in FIG. 2), the filter including: a first assembly layer (FIL1) that includes: a first copper region ([0049]) having a first surface; a second assembly layer (FIL2) having a second surface hybrid bonded to the first surface, the second assembly layer including: a second region of a material with oxide, the first copper region is in contact with the material with oxide ( RDl1 and [0049] i.e. made of dielectric).
Allowable Subject Matter
Claims 15 and 19-20 are objected to as being dependent upon a rejected base claim, but would be allowable if rewritten in independent form including all of the limitations of the base claim and any intervening claims.
Claim 21-33 are allowed. The reference of the record, Girard Desprolet, teaches a first assembly layer and second structure layer, but fails to teach a first dielectric material in alternation with second copper portion and a plane of the second surface , third portion on an oxide in alternation with fourth portions made of a second dielectric material and the second copper portion are in contact with the oxide of the third portion.
