Notice of Pre-AIA or AIA Status
The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA .
Election/Restrictions
Applicant's election with traverse of invention I, claims 1-10 in the reply filed on 07/27/2026 is acknowledged. The traversal is on the ground(s) that there is no serious burden because the claimed inventions overlap in scope and have common elements such as “a horizontal channel, an interlayer insulating layer, a vertical channel structure, etc.), and that by searching for one group, the other would naturally be found if there is art. This is not found persuasive because while there is some overlap in scope, it is still apparent that inventions I and II are distinct. As pointed out in the restriction requirement dated 05/29/2026, there is a search burden as invention I would require searching devices using the same style of field effect transistor, whereas the device from invention II would not require this search. Yes, during search there may be some overlap in scope, however, both inventions still require their own areas of search that the other does not require.
The requirement is still deemed proper and is therefore made FINAL.
Claims 11-20 are withdrawn from further consideration pursuant to 37 CFR 1.142(b), as being drawn to a nonelected invention II, there being no allowable generic or linking claim. Applicant timely traversed the restriction (election) requirement in the reply filed on 07/27/2026.
Drawings
The drawings are objected to because in brief description of drawings Fig 10 is supposed to be based on the B1-B1’ dashed line from Fig. 9. However, B1-B1’ in Fig. 9 is not a line and more of an L-Shape. The B1 or B1’ appear mislabeled or misplaced, based on the fact that Fig. 10 has the Con region and the MCR region. Examiner assumes that the dashed line is supposed to follow only the labeled x-axis and more horizontally across Fig. 9.
Corrected drawing sheets in compliance with 37 CFR 1.121(d) are required in reply to the Office action to avoid abandonment of the application. Any amended replacement drawing sheet should include all of the figures appearing on the immediate prior version of the sheet, even if only one figure is being amended. The figure or figure number of an amended drawing should not be labeled as “amended.” If a drawing figure is to be canceled, the appropriate figure must be removed from the replacement sheet, and where necessary, the remaining figures must be renumbered and appropriate changes made to the brief description of the several views of the drawings for consistency. Additional replacement sheets may be necessary to show the renumbering of the remaining figures. Each drawing sheet submitted after the filing date of an application must be labeled in the top margin as either “Replacement Sheet” or “New Sheet” pursuant to 37 CFR 1.121(d). If the changes are not accepted by the examiner, the applicant will be notified and informed of any required corrective action in the next Office action. The objection to the drawings will not be held in abeyance.
