Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . Applicant's arguments filed 3/20/26 have been fully considered but they are not persuasive. Applicant alleges that the composition of the present filing demonstrates unexpected results. Such unexpected results have not been shown to be commensurate in scope with the claimed invention. Such unexpected results are not seen as being comparative with the closest prior art. The only comparison mentioned in the 3/20/26 remarks is a “Comparative 1” polymer of uncertain origin and composition. The discussion of the biodegradability of secondary reference Gagnon is mere attorney argument and weighted accordingly. The text of those sections of Title 35, U.S. Code not included in this action can be found in a prior Office action. Claims 1-2 and 16-20 are rejected under 35 U.S.C. 103 as being unpatentable over Hoffman (DE 103 18 522 A1); citations are to its English machine translation PDF accessed online from Espacenet) in view of Gagnon et al. (EP 0 338 396).
