Notice of Pre-AIA or AIA Status
The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA .
DETAILED ACTION
Claim Rejections - 35 USC § 112(b)
The following is a quotation of 35 U.S.C. 112(b):
(b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention.
Claims 19 and 20 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as failing to disclose sufficient structure for the claimed node.
Re claim 19, The node needs combination of elements (processor, memory, module, interface).
Claim 20 is similarly rejected.
Allowable Subject Matter
Claims 1-18 are allowable.
The following is an examiner's statement for reasons for allowance.
Claim 1 is allowable over the prior art of record since the cited references taken individually or in combination fail to particularly teach or fairly suggest deciding whether a wireless carrier signal is assigned either to serving user plane traffic, to serving control plane traffic, or to serving both user plane traffic and control plane traffic based on the predicted data throughput of user plane traffic and control plane traffic generated by wireless communication devices being served by access nodes on a plurality of wireless carrier signals.
