Notice of Pre-AIA or AIA Status
The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA .
Notice of Acknowledgement
The Examiner has generated an Ex parte Quayle Action by mistake, and the Quayle Action was mailed on 2/26/2026. This non-final action is generated for correction of the mailed Ex parte Quayle Action.
Drawings
Figure 1 should be designated by a legend such as --Prior Art-- because only that which is old is illustrated. See MPEP § 608.02(g). Corrected drawings in compliance with 37 CFR 1.121(d) are required in reply to the Office action to avoid abandonment of the application. The replacement sheet(s) should be labeled “Replacement Sheet” in the page header (as per 37 CFR 1.84(c)) so as not to obstruct any portion of the drawing figures. If the changes are not accepted by the examiner, the applicant will be notified and informed of any required corrective action in the next Office action. The objection to the drawings will not be held in abeyance.
Claim Rejections - 35 USC § 102
In the event the determination of the status of the application as subject to AIA 35 U.S.C. 102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory basis (i.e., changing from AIA to pre-AIA ) for the rejection will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status.
The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action:
A person shall be entitled to a patent unless –
(a)(2) the claimed invention was described in a patent issued under section 151, or in an application for patent published or deemed published under section 122(b), in which the patent or application, as the case may be, names another inventor and was effectively filed before the effective filing date of the claimed invention.
Claims 1, 11 and 15 are rejected under 35 U.S.C. 102(a)(2) as being anticipated by Santhanam et al. (US 2022/0217042 A1), hereinafter Santhanam.
Regarding claim 1, Santhanam teaches A method in a network node configured to communicate with a wireless device, WD, the method comprising: receiving user assistance information, UAI, comprising an indication of at least one of a zero bandwidth for a frequency band and a component carrier to be disabled; and determining an allocation of at least one of a bandwidth and at least one component carrier based at least in part on whether the indicated at least one of the zero bandwidth and the component carrier to be disabled would exclude a primary component carrier by which the network node and the WD maintain communication in a cell (see paragraph 0107; the UE 115-a transmits assistance information 220 requesting an update to the configured maximum quantity of component carriers or the configured maximum aggregated bandwidth for the MCG or the SCG (e.g., requesting an update of maxBW-Preference or maxCC-Preference), the base station 105-a may transmit the re-configuration 225 via RRC signaling (such as via the RRCReconfiguration information element) to release one or more component carriers or to release some bandwidth allocated for the SCG. In some implementations, such as in implementations in which the UE 115-a requests a reduction of the quantity of component carriers to zero or a reduction of the aggregated bandwidth for the SCG to zero, the base station 105-a may transmit the re-configuration 225 to release all component carriers or to release the SCG (such that the UE 115-a may refrain from monitoring for communication over all released component carriers or over the SCG) and see paragraph 0142; the UE 115-e may set one or more of the reduced BW-FR1-DL parameter, the reducedBW-FR1-UL parameter, the reducedBW-FR2-DL parameter, or the reducedBW-FR2-UL parameter to a ReducedAggregatedBandwidth value to indicate a request for a maximum aggregated bandwidth for the SCG (or the MCG, or both, in some cases) to be configured as the ReducedAggregatedBandwidth value).
Regarding claim 11, this claim has similar limitations as those of claim 1. Therefore, it is rejected under Santhanam for the same reasons as set forth in the rejection of claim 1.
Regarding claim 15, the base station 105 a-fig.2 could transmits the configuration 215 configuring assistance of maximum aggregated (or total) bandwidth for the SCG (and for a master cell group (MCG), in some cases), see 0096, or the base station 105- a may generate or otherwise determine the configuration 215 based on a capability of the UE 115-a, such as a UECapabilnyInformation(maxBW-Preference, maxCC- Preference) information element, so that the configured total bandwidth does not exceeds a threshold, see 0097.
Allowable Subject Matter
7. Claims 21-23 are allowed.
8. Claims 4, 6-7, 9, 14, 16-17, and 19-20 are rejected based on its dependency, would be allowable if rewritten or amended to include all of the limitations of the base claim and any intervening claims.
Conclusion
9. The prior art made of record and not relied upon is considered pertinent to applicant's disclosure. Araujo (US 20240195594) is cited, and considered pertinent to the instant specification.
