The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA .
Claim Rejections - 35 USC § 112
The following is a quotation of 35 U.S.C. 112(b):
(b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention.
The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph:
The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention.
Claims 11 – 19 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being incomplete for omitting essential elements, such omission amounting to a gap between the elements. See MPEP § 2172.01. The omitted elements are (claim 11):
Identifying, by the SCP”;
“testing, by the SCP”;
“determining, by the SCP”; and
“updating, by the SCP”.
It is not clear, given the specification (see amendments and associated arguments on 03/09/2026) and given the closely mirrored related independent claims 1 and 20, if the “identifying”, “testing”, “determining”, and “updating” features in claim 11 are implemented by the SCP.
Appropriate correction and/or explanation is necessary to clarify the record.
