Claim Rejections - 35 USC § 112
Claim 13 is rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention.
Claim 13 should recite method steps. Therefore the claims are awkwardly and confusingly worded. To Correct the applicant should provide steps:---- then recite limitation.
Allowable Subject Matter
Claims 1-12 and 14 are allowed.
The following is an examiner’s statement of reasons for allowance:
The instant invention is neither anticipated nor rendered obvious by the prior art for at least not withstanding other reasons because a device is not disclosed nor taught having at least two bases, a damping mechanism, a holder, first and second drivers with second driver configured to micro-driver damping mechanism being claimed in combination with the other claimed limitations.
The claims are allowed because of the combination of limitations found in the claims and configuration and components that are required in the combination of limitations. The isolation of limitations would NOT portray accurately the patentability of the claims. As Noted US Application 2009/0324813 A1 has a damper but DOES NOT have multiple bases connected to a holder, with first and second driver configured to micro-driver damping mechanism being claimed in combination.
Conclusion
The prior art made of record and not relied upon is considered pertinent to applicant's disclosure. The prior art being made of record does not read, anticipate, nor render obvious the claimed invention of record.
