Status of Prosecution This office action considers claims 1-10, in “Claims - 04/11/2024”, pending for prosecution and are examined on their merits. Claim Rejections - 35 USC § 112 The following is a quotation of 35 U.S.C. 112(b): (b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention. 07-35 Claims 1-10 are rejected under 35 U.S.C. 112(b), second paragraph, as being indefinite in that it fails to point out what is included or excluded by the claim language. This claim 1 is an omnibus type claim. Regarding claim 1, recited phrase “a molar ratio of a sum of the X and I to the B is 2.80 or more and 3.25 or less, and a molar ratio of the B to the A is more than 1.00 and 1.50 or less, that does not to point out what is included or excluded by the claim language. There is neither a bounded formula nor any bounded structure that can evaluate the molar ratio of each unknown mole variables relationship, instead these claim limitation being used as a "catch-all" to secure broad, undefined coverage. The specification disclose, in [0034], a partial description as “perovskite compound refers to a perovskite crystal structure represented by a chemical formula ABX's or a structure including a crystal similar thereto; but, even missing element “I” therein, Thus, specification does not provide a standard for ascertaining the requisite degree, and one of ordinary skill in the art would not be reasonably apprised of the scope of the invention. This. "catch-all" to secure broad, undefined coverage. makes the claim an omnibus type claim. Appropriate clarification and/or correction are/is required within metes and bounds of the claimed invention. Regarding Claims 2-10, those are rejected under 35 U.S.C. 112 (b), because of their dependency status from claim 1. Prior Art Rejections As there is a great deal of confusion and uncertainty as to the proper interpretation of the limitations of claim 1 (and dependent claims 2-10), it would not be proper for the examiner to reject such a claim on the basis of prior art. See MPEP § 706. 03 and MPEP § 2173.06.II (second) wherein In re Steele, 305 F.2d 859, 134 USPQ 292 (CCPA 1962), a rejection under 35 U.S.C. 103 should not be based on considerable speculation about the meaning of terms employed in a claim or assumptions that must be made as to the scope of the claims. The prior art made of record form PTO-892 can be used to reject claims 1-10 , once the issues in sections I, supra is resolved.
