The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . This Office Action is in response to the submission filed 0001-01-01 (herein referred to as the Reply) where claim(s) 1-7, 14-16 are pending for consideration.
Election/Restrictions
Claim(s) 8-13 is/are withdrawn from further consideration pursuant to 37 CFR 1.142(b) as being drawn to a nonelected invention, there being no allowable generic or linking claim. Election was made without traverse in the Reply.

35 USC §112(b) – Claim Rejections
The following is a quotation of 35 U.S.C. 112(b):
(b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention.
Claim(s) is/are rejected under 35 U.S.C. 112(b) for not particularly pointing out and distinctly claiming the subject matter of the invention.

The dependent claim(s) recite preambles of variants:
“An apparatus according to…”
Because the term “an” is used instead of “the” is unclear as to whether the dependent claims are referring to the apparatus of claim 1, or attempts to introduce a new, independent apparatus but is similar to the apparatus of claim 1.
Furthermore, when subsequent citations of "the apparatus" are recited, it is unclear which particular “apparatus” (since there at least two previously introduced similarly named elements) is being referring to.

Claim(s) is/are indicated as having allowable subject matter and is considered allowable.

In addition to the explicit reasons given herein, allowability is also determined in view of the combination of references required for obviousness, the inter-relationship between other claimed limitations, and the claimed invention as a whole. Accordingly, amendments that do not incorporate the allowable claims into the base/intervening claims in its entirely, are not allowable. This includes amendments that incorporate the allowable claims into the base/intervening claims in part or in a non-narrowing manner (i.e., changing the scope of the subject matter).

MATHINI - WO2022123259 teaches “the machine learning system may choose the symbols to which the bits of the user input streams are to be mapped and may add higher dimensions to a constellation diagram than would be achievable/allowed in conventional modulation during the joint training of the encoder and plurality of decoder mappings” but does not teach the input streams being image-based input data and sensor-based input data. Further the reference does not teach adding a reference signal.
JOHANNES - WO2022253400 teaches obtain bits to be transmitted; map the bits into a symbol grid in time-frequency domain; modulate the symbol grid into a first time-domain waveform; input the first time-domain wave form into a machine learning model, producing a second time-domain waveform” but does not teach the input streams being image-based input data and sensor-based input data. Further the reference does not teach adding a reference signal.
JIANG - CN114071424 teaches the first mobile terminal encodes the video data and the sensor data, so as to obtain the process of the image data; the video data and the sensor data are subjected to channel coding, spread spectrum, interleaving and modulation in turn but does not teach encoding the data by mapping the data to symbols.
HARRSION - US20130094524 teaches the modulation symbol sequences are then spread and a reference signal is added using the same spreading and reference signal as their corresponding virtual antenna but does not teach use of encoding using machine learning for image-based data and sensor-based data mapping to symbols.
XIAO - WO2023030464 teaches artificial intelligence module can be a mapping module or a classification module, or a clustering module, which can map the input modulation information to its corresponding modulation symbol or modulation symbol group but does not teach the input streams being image-based input data and sensor-based input data. Further the reference does not teach adding a reference signal.
