DETAILED ACTION Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . Priority Receipt is acknowledged of certified copies of papers required by 37 CFR 1.55. Information Disclosure Statement The information disclosure statement (IDS) submitted on 05/04/2024 has been considered by the examiner. Claim Rejections - 35 USC § 102 The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action: A person shall be entitled to a patent unless – (a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention. (a)(2) the claimed invention was described in a patent issued under section 151, or in an application for patent published or deemed published under section 122(b), in which the patent or application, as the case may be, names another inventor and was effectively filed before the effective filing date of the claimed invention. Claims 1-4,12, and 18 are rejected under 35 U.S.C. 102 a1.a2 as being anticipated Furuta et al. by US 20230016797 A1. (Furuta, hereafter) Regarding claim 1, Furuta display device(Figures 1-16 and corresponding text) (Figure 1A) comprising (100): a first pixel electrode (2)and a second pixel electrode disposed(2) on the substrate; a first light-providing layer (5)disposed on the first pixel electrode (2); a second light-providing layer (5), same numbers provided for both pixels) disposed on the second pixel electrode (2); a common electrode(6) disposed on the first light-providing layer (5)and the second light-providing layer; and a current capture layer(11,eaves) disposed between the first pixel electrode(2) and the second pixel electrode(6) in a plan view.(π29-π30). Regarding claims 2 and 3, the limitations wherein a capture voltage applied to the current capture layer is lower than a pixel voltage applied to the first pixel electrode (claim 2); wherein the capture voltage is identical to a common voltage applied to the common electrode (Claim 3) deal with modus operandi which is different from the device that is claimed as such these limitations are considered not germane to the claimed device. Regarding claim 4, Furuta discloses((Figure 1A) wherein a bank (3, partition) overlapping the current capture layer(11,eaves) in a plan view and defining a first emission (10R)area of the first pixel electrode and a second emission area (10G) of the second pixel electrode(π009). Regarding claim 12, Furuta discloses (Figure 1A): a first color filter (9R) overlapping the first emission area; and a second color filter(9G) overlapping the second emission area.(π30) Regarding claim 18, Furuta discloses wherein each of the first light-providing layer and the second light-providing layer comprises a plurality of light-emitting units providing lights of different colors(π29). Allowable Subject Matter Claims 5, 13, and 16 are objected to as being dependent upon a rejected base claim, but would be allowable if rewritten in independent form including all of the limitations of the base claim and any intervening claims. Claims 6-11,14, and 17 are objected to due to their dependence upon the above claims respectively. Conclusion The prior art made of record and not relied upon is considered pertinent to applicant's disclosure.
