Office Action

§102 §103
Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . Prior Art of Record The applicant's attention is directed to additional pertinent prior art cited in the accompanying PTO-892 Notice of References Cited, which, however, may not be currently applied as a basis for the following rejections. While these references were considered during the examination of this application and are deemed relevant to the claimed subject matter, they are not presently being applied as a basis for rejection in this Office action. The pertinence of these documents, however, may be revisited, and they may be applied in subsequent Office actions, particularly in light of any amendments or further clarification of the claimed invention. Response to Arguments Applicant’s arguments with respect to claim(s) have been considered but are moot because the new ground of rejection does not rely on any reference applied in the prior rejection of record for any teaching or matter specifically challenged in the argument. Claim Rejections - 35 USC § 102 In the event the determination of the status of the application as subject to AIA 35 U.S.C. 102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory basis (i.e., changing from AIA to pre-AIA ) for the rejection will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status. The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action: A person shall be entitled to a patent unless – (a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention. Claim(s)1-2, 4-6, 8, 10-12, 18-20- is/are rejected under 35 U.S.C. 102(a)(1) as being anticipated by Yang. (US 2022/0093593 A1). PNG media_image1.png 600 650 media_image1.png Greyscale CLAIM 1. Yang teaches the transistor of claim 1, wherein a cross section of the semiconductor layer 14A surrounding the gate electrode GS1 is U-shaped or two separated lines (Yang - Fig. 1; ¶ [0050]-[0053]). Claim Rejections - 35 USC § 103 In the event the determination of the status of the application as subject to AIA 35 U.S.C. The following is a quotation of 35 U.S.C. 103 which forms the basis for all obviousness rejections set forth in this Office action: A patent for a claimed invention may not be obtained, notwithstanding that the claimed invention is not identically disclosed as set forth in section 102, if the differences between the claimed invention and the prior art are such that the claimed invention as a whole would have been obvious before the effective filing date of the claimed invention to a person having ordinary skill in the art to which the claimed invention pertains. Patentability shall not be negated by the manner in which the invention was made. Claim(s) 7 is/are rejected under 35 U.S.C. 103 as being unpatentable over Yang et al. (US 2022/0093593 A1) in view of Le et al. (US 2018/0366587 A1) CLAIM 7. Yang teaches the transistor of claim 1 as set forth above (Yang - Fig. 1; ¶ [0050]-[0053]). Yang does not explicitly disclose that the material of the semiconductor layer 14A is a metal oxide semiconductor material. Le teaches non-planar and gate-all-around transistor structures (e.g., fins, nanoribbons, nanowires) utilizing an amorphous indium gallium zinc oxide (a-IGZO) material for the semiconductor channel layer 240 to improve electrostatics and reduce leakage (Le - Title; Abstract; Fig. 2C; ¶17-23). It would have been obvious to a person having ordinary skill in the art (POSITA) at the time of the invention to modify the transistor structure of Yang by substituting the semiconductor channel material 14A with a metal oxide semiconductor material (such as the a-IGZO taught by Le) in order to improve electrostatics and reduce off-state leakage current in the device, since simple substitution of one known element for another to obtain predictable results is considered obvious to one of ordinary skill in the art (KSR International Co. v. Teleflex Inc., 550 U.S.-, 82 USPQ2d 1385). Conclusion Applicant's amendment necessitated the new ground(s) of rejection presented in this Office action. Accordingly, THIS ACTION IS MADE FINAL. See MPEP § 706.07(a). Applicant is reminded of the extension of time policy as set forth in 37 CFR 1.136(a). A shortened statutory period for reply to this final action is set to expire THREE MONTHS from the mailing date of this action. In the event a first reply is filed within TWO MONTHS of the mailing date of this final action and the advisory action is not mailed until after the end of the THREE-MONTH shortened statutory period, then the shortened statutory period will expire on the date the advisory action is mailed, and any nonprovisional extension fee (37 CFR 1.17(a)) pursuant to 37 CFR 1.136(a) will be calculated from the mailing date of the advisory action. In no event, however, will the statutory period for reply expire later than SIX MONTHS from the mailing date of this final action.
