DETAILED ACTION Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . According to a preliminary amendment filed on Dec. 27, 2024, the applicants have canceled claims 4-10, 13-15, 17-29, 33-54, 56, 59-61, 63-65 and 67-89; amended claims 1-3, 11-12, 16, 32, 55, 58, 62 and 66 and furthermore, have added new claims 90-95. Claims 1-3, 11-12, 16, 30-32, 55-57-58, 62, 66 and 90-95 are pending in the application. Claim Rejections - 35 USC § 112 4. The following is a quotation of 35 U.S.C. 112(b): (b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention. The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph: The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention. Claims 62, 66, 91-92 and 94-95 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention. In claims 62, 91 and 94, it is not clear who is being administered compounds of claims 1, 32 or 57? In claims 66, 92 and 95, specific diseases being treated in a subject are not defined. Allowable Subject Matter The following is a statement of reasons for the indication of allowable subject matter: Claims 1-3, 11-12, 16, 30-32, 55, 57-58, 90 and 93 are allowed since the instant compounds of formulae (I) or (II) are neither disclosed nor obvious over the prior art. In the prior art, Zheng (WO 2020/163823 A2, cited on applicant’s form 1449) discloses compounds in examples 48-56 (see pages 219-238) which do anticipate the instant compounds of formula (II) of claim 32. However, these compounds are excluded by a proviso in claim 32.
