DETAILED ACTION
Notice of Pre-AIA or AIA Status
The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA .
Claim Status
Claims 1-14 are pending. They comprise of 1 group:
Method1: 1-14.
As of 06/16/24, independent claim 1 is as followed:
1. (currently amended) A method for securely capturing data from devices, for purposes of calibration or gaging, comprising:
[1] setting up a digitized process sequence in a data chain (DLT), which is created and protected using a distributed ledger technology,
[2] registering a device (D) which is configured to output encrypted measurement information, with implemented measuring device properties of the device (D), in the data chain (DLT),
[3] gaining access by an inspection authority (I) to the measurement information from the device (D),
[4] establishing by the inspection authority (I) an operative connection, which is protected by the data chain (DLT), between the device (D) and a working standard (A), wherein the working standard is provided with identification data such that there is encrypted identification of the working standard and separate, unencrypted identification of the working standard,
[5] reading out determined measurement data for the working standard (A) in encrypted form and transmitting to the inspection authority (I) in encrypted form, in the event of successful calibration or gaging of the device, storing by the inspection authority (I) this result in the data chain (DLT).
Note: numerals [1]-[5] are added to the beginning of each step.
Claim Rejections - 35 USC § 112
Claims 1-14 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention.
1) In independent claim 1, the preamble calls for “a method for securely capturing data from devices for purposes of calibration or gaging” but there is no discussion of the “calibration or gaging” in the cited 5 steps. feature “compliance” in the claim steps. The last step calls for “adapting execution behavior accordingly” is broad and does not address how the compliance is carried out.
2) In independent claim 1, the abbreviation (DLT) after the term “a data chain” is vague and should be removed.
3) In independent claim 1, it’s not clear the relationship of step [1] “setted digitized process sequence in a data chain” to steps [2]-[5]?
4) In independent claim 1, the abbreviation (I) after the term “an inspection authority” is vague and should be removed.
5) In independent claim 1, step [5], the term “determined measurement data” lack antecedent basis for the term “determined.” Is there a step of “determining of measurement data”?
In independent claim 1, step [5], it’s not clear what are being transmitted to the inspection authority?
In independent claim 1, step [5], it’s not clear how the “event of successful calibration or gaging of the device” is determined?
In independent claim 1, step [5], the term “this result” is vague because it’s not clear how the “this result” is defined and/or came from?
