Claim Rejections - 35 USC § 102 07-07-aia AIA 07-07 The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action: A person shall be entitled to a patent unless – 07-08-aia AIA (a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention. 07-15 AIA Claim s 13 and 17 are rejected under 35 U.S.C. 102( a)(1 ) as being anticipated by Kim et al. (US 2020/0373513) . PNG media_image1.png 479 656 media_image1.png Greyscale (Claim 13) Kim et al. teach an electronic device comprising: a base layer (BS); a circuit layer (CL) disposed on the base layer; an element layer (LD) disposed on the circuit layer and including a light emitting element (EM) in which a light emitting area is defined; an encapsulation layer (TFE, paragraph 70) disposed on the element layer; a light shielding layer (BM1) which is disposed on the encapsulation layer and in which an opening corresponding to the light emitting area is defined (paragraph 74); a color filter disposed (CF1) on the light shielding layer and configured to cover the opening; and a brightness control layer (WCL1) disposed between the light emitting element and the opening, wherein a transmittance of the brightness control layer is higher than a transmittance of the light shielding layer (paragraphs 73). (Claim 17) Kim et al. teach wherein the brightness control layer (WCL1) is spaced apart from the light shielding layer (BM1) . Allowable Subject Matter 12-151-08 AIA 07-43 12-51-08 Claim s 14 – 16 and 18 – 20 are objected to as being dependent upon a rejected base claim, but would be allowable if rewritten in independent form including all of the limitations of the base claim and any intervening claims. Claims 1 – 12 are allowable, because prior art does not teach: (Claim 1) wherein the brightness control layer includes a first edge and a second edge surrounding the first edge, the first edge overlaps the first light emitting area in the plan view, and the second edge overlaps the light shielding layer in the plan view.
