Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . Claim Rejections - 35 USC § 102 The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action: A person shall be entitled to a patent unless – (a)(2) the claimed invention was described in a patent issued under section 151, or in an application for patent published or deemed published under section 122(b), in which the patent or application, as the case may be, names another inventor and was effectively filed before the effective filing date of the claimed invention. Claim(s) 1, 6, 9-11, 16 is/are rejected under 35 U.S.C. 102(a)(2) as being anticipated by Shrivastava US 20240340653. Regarding claim 1, 9, 16, Shrivastava teaches an apparatus, comprising: at least one processor (processor circuitry, [0123]); and at least one memory (memory, [0123]) including computer program code, the at least one memory and the computer program code configured to, with the at least one processor, cause the apparatus at least to: receive a request (processor circuitry configured to generate at least one message which requests the wireless terminal to report Artificial Intelligence / Machine Learning Model (AI/ML) related information to the network, [0137]) for supported functionalities (UE CapabilityInformation, [0075], wherein the AI/ML related information comprises AI/ML related support information of the wireless terminal, [0142]) and functionality selection assistance information (to receive at least one resource restriction response message from the wireless terminal, the resource restriction response message comprising an indication that the wireless terminal guards AI/ML model and/or AI/ML functions of the wireless terminal, [0224], the processor circuitry is configured to generate a resource restriction notification message to configure the wireless terminal to generate the resource restriction response message, [0225]) from a network node; identify the supported functionalities; determine the functionality selection assistance information; and provide an indication of the supported functionalities and the functionality selection assistance information to the network node (see above [0137, 0142, 0224, 0225]). Regarding claim 6, the request for supported functionalities from the network node comprises a request for functionality selection assistance information (the processor circuitry is configured to generate a resource restriction notification message to configure the wireless terminal to generate the resource restriction response message, [0225]). Regarding claim 10, the supported functionalities comprise Artificial Intelligence (AI) / Machine Learning (ML) functionalities configured to perform a feature (processor circuitry configured to generate at least one message which requests the wireless terminal to report Artificial Intelligence / Machine Learning Model (AI/ML) related information to the network, [0137]). Regarding claim 11, wherein the feature comprises an Artificial Intelligence (AI) / Machine Learning (ML) feature (processor circuitry configured to generate at least one message which requests the wireless terminal to report Artificial Intelligence / Machine Learning Model (AI/ML) related information to the network, [0137]). Allowable Subject Matter Claims 2-5, 7, 8, 12-15, and 17-20 are objected to as being dependent upon a rejected base claim, but would be allowable if rewritten in independent form including all of the limitations of the base claim and any intervening claims.
