Office Action

§101
Detailed Action Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . Status of Claims The following is in response to the communication filed 7/24/2024. Claims 1-20 are currently pending. Claims 1-20 have been examined. Priority Applicant' s claim for the benefit of prior-filed application under 35 U.S.C. 119(e) or under 35 U.S.C. 120, 121, or 365(c) is acknowledged. The application is the continuation of 18451366 filed 09/27/2021, being a continuation of 17486633 filed 09/27/2021, where 17486633 filed 10/18/2019, being a continuation of 16657696 filed 10/18/2019, where 16657696 claims benefit to Provisional Patent Application Serial No. 62/902,207 and 62/748,653 filed 9/18/2019 and 10/22/2018 has been received and acknowledged Information Disclosure Statement The information disclosure statements (IDS) submitted on 9/5/2024 has been considered by the Examiner. Applicant is reminded that per MPEP 2004, it is desirable to avoid the submission of long lists of documents if it can be avoided and that if a long list is submitted, Applicant is encouraged to highlight those documents which have been specifically brought to Applicant’s attention and/or are known to be of most significance. Applicant is also encouraged to submit a concise statement of the relevance of each reference in the IDS(s). For this application, it is noted that the aforementioned IDSs collectively include a very lengthy list of documents. As best as can be ascertained from the record, however, no particular listed document has been specifically brought to the Examiner's attention or otherwise highlighted to be of particular significance. Thus, by signing the accompanying IDS document(s), the Examiner is acknowledging the submission of the document(s) and indicating that a cursory review has been made of the listed document only to the extent reasonably possible in view of the very large number of documents listed. Specification The title of the invention is not descriptive. A new title is required that is clearly indicative of the invention to which the claims are directed. The following title is suggested: INTERCONNECT STRUCTURES WITH EMBEDDED FILL LAYERS Claim Objections Claim 6 is objected to because of the following informalities: Claim 6 includes the number “7” before rest of the claim. The Examiner believes this to be an typo and suggests that it be removed in any subsequent action. Appropriate correction is required. Claim Rejections - 35 USC § 101 Double Patenting: STATUTORY: A rejection based on double patenting of the “same invention” type finds its support in the language of 35 U.S.C. 101 which states that “whoever invents or discovers any new and useful process... may obtain a patent therefor...” (Emphasis added). Thus, the term “same invention,” in this context, means an invention drawn to identical subject matter. See Miller v. Eagle Mfg. Co., 151 U.S. 186 (1894); In re Vogel, 422 F.2d 438, 164 USPQ 619 (CCPA 1970); In re Ockert, 245 F.2d 467, 114 USPQ 330 (CCPA 1957). A statutory type (35 U.S.C. 101) double patenting rejection can be overcome by canceling or amending the claims that are directed to the same invention so they are no longer coextensive in scope. The filing of a terminal disclaimer cannot overcome a double patenting rejection based upon 35 U.S.C. 101. Claims 1-20 are rejected under 35 U.S.C. 101 as claiming the same invention as that of claims 1, 3-18, and 20-23 of prior U.S. Patent No. 11756880. This is a statutory double patenting rejection.
