DETAILED ACTION
Claim Rejections - 35 USC § 102
The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action:
A person shall be entitled to a patent unless –
(a)(2) the claimed invention was described in a patent issued under section 151, or in an application for patent published or deemed published under section 122(b), in which the patent or application, as the case may be, names another inventor and was effectively filed before the effective filing date of the claimed invention.
Claims 8-9 are rejected under 35 U.S.C. 102(a)(2) as being anticipated by Chae et al. (Chae, US 2019/0164944 A1).
The applied reference has a common assignee with the instant application. Based upon the earlier effectively filed date of the reference, it constitutes prior art under 35 U.S.C. 102(a)(2). This rejection under 35 U.S.C. 102(a)(2) might be overcome by: (1) a showing under 37 CFR 1.130(a) that the subject matter disclosed in the reference was obtained directly or indirectly from the inventor or a joint inventor of this application and is thus not prior art in accordance with 35 U.S.C. 102(b)(2)(A); (2) a showing under 37 CFR 1.130(b) of a prior public disclosure under 35 U.S.C. 102(b)(2)(B) if the same invention is not being claimed; or (3) a statement pursuant to 35 U.S.C. 102(b)(2)(C) establishing that, not later than the effective filing date of the claimed invention, the subject matter disclosed in the reference and the claimed invention were either owned by the same person or subject to an obligation of assignment to the same person or subject to a joint research agreement.
Regarding claim 8, Chae shows a light emitting apparatus, comprising: a circuit board including an upper electrode ( electrode 1710a in FIG. 48), a lower electrode (lower electrode 1250), and an intermediate electrode (electrode 1450) disposed between the upper electrode (electrode 1710a) and the lower electrode (electrode 1250); and a first light emitter (LED 1430) disposed on the circuit board and including semiconductor layers and connection electrodes (electrode 1730a) electrically connected to at least one of the upper electrode (electrode 1710a), the lower electrode (electrode 1250), or the intermediate electrode (electrode 1450), wherein the upper electrode (electrode 1710a) and at least one of the connection electrodes overlap (electrode 1730a) in a first direction, and wherein the connection electrodes (electrode 1730a) include a first connection electrode including a first side surface facing a center of the first light emitter (LED 1430) and a second connection electrode (electrode 1710) including a second side surface facing the first side surface (see FIG. 48), and wherein the first side surface is longer than the second side surface in the first direction (see FIG. 48).
Regarding claim 9, Chae shows a light emitting apparatus, comprising a protection layer disposed between the first connection electrode (electrode 1730a) and the second connection electrode (electrode 1710) covering a side region of the semiconductor layers (see FIG. 48).
Allowable Subject Matter
Claims 1-7 and 15-20 are allowed.
Regarding claims 1 and 15, Chae teaches a light emitting apparatus, but fails to teaches the connection electrodes includes a first length facing the third direction of the first light emitter relative to the first direction and second length facing the second direction of the first light emitter relative to the first direction and the first length is greater than the second length.
Claims 10-14 are objected to as being dependent upon a rejected base claim, but would be allowable if rewritten in independent form including all of the limitations of the base claim and any intervening claims.
