Claim Rejections - 35 USC § 103
The following is a quotation of 35 U.S.C. 103 which forms the basis for all obviousness rejections set forth in this Office action:
A patent for a claimed invention may not be obtained, notwithstanding that the claimed invention is not identically disclosed as set forth in section 102, if the differences between the claimed invention and the prior art are such that the claimed invention as a whole would have been obvious before the effective filing date of the claimed invention to a person having ordinary skill in the art to which the claimed invention pertains. Patentability shall not be negated by the manner in which the invention was made.
Claim(s) 1-20 is/are rejected under 35 U.S.C. 103 as being unpatentable over Cheng et al. (US20190067452A1) in view of Cheng et al. (US20200044060A1).
Regarding claim 1, Cheng teaches a method, comprising:
depositing a plurality of alternating layers of first and second semiconductor layers (110, 112) on a substrate (102), wherein the substrate (102) comprises germanium {Figs. 1A-1, 1A-2, 4; [0019, 0023]};
forming a source/drain region (132B and/or 134) in contact with the plurality of first and second semiconductor layers (110, 112) {Figs. 1B-1, 1B-2, 4B; [0049]};
removing first semiconductor layers (112) to form a plurality of first openings between the plurality of second semiconductor layers (110) and a second opening between a bottom-most second semiconductor layer (110) and the substrate (102) {Figs. 2E-1, 2E-2, 3E-1, 3E-2; [0103, 0104]; see annotated copies of Cheng’s Figs. 3E-1, 3E-2 below; second opening is between lowermost 110 and 102 along a diagonal line};
removing an upper portion of the substrate (102) through the second opening to form a third opening, wherein the bottom surface of the source/drain region (132B and/or 134) extends into the substrate (102) {Figs. 2E-1, 2E-2, 3E-1, 3E-2; [0103, 0104]; see annotated copies of Cheng’s Figs. 3E-1, 3E-2 below};
forming a gate structure (162, 164) {Figs. 2J-1, 2J-2, 2K-1, 2K-2, 3J-1, 3J-2, 3K-1, 3K-2; [0150]}, comprising:
forming a first portion (portion of 162, 164 within first openings) of the gate structure (162, 164) within each of the first openings {Figs. 2J-1, 2J-2, 2K-1, 2K-2, 3J-1, 3J-2, 3K-1, 3K-2; [0150]}; and

Cheng does not necessarily teach the third opening extends below a bottom surface of the source/drain region.
In an analogous art, Cheng ‘060 teaches in Figs. 2A, and 30B and paragraphs [0105-0106] a third opening (59 filled by 106, 106 in Fig. 2A) extends below a bottom surface of the source/drain region (80). It would have been obvious to one of ordinary skill in the art before the effective filing date of the claimed invention to modify Cheng’s method based on the teachings of Cheng ‘060, to achieve the above-identified subject matter, so [a] gate structure is formed around the first semiconductor layers. Cheng ‘060 [0116]. Moreover, applying a known technique in the same way to enhance another known technique to achieve a predictable result is within the capability of one of ordinary skill in the art. MPEP §2143(I)(C). Moreover, [t]he selection of a known … [structure] based on its suitability for its intended use [is] … prima facie obviousness. MPEP §2144.07. Furthermore, a person of ordinary skill has good reason to pursue the known options within his or her technical grasp. MPEP §2143((I)(E).
