Claim Rejections - 35 USC § 112
The following is a quotation of the first paragraph of 35 U.S.C. 112(a):
(a) IN GENERAL.—The specification shall contain a written description of the invention, and of the manner and process of making and using it, in such full, clear, concise, and exact terms as to enable any person skilled in the art to which it pertains, or with which it is most nearly connected, to make and use the same, and shall set forth the best mode contemplated by the inventor or joint inventor of carrying out the invention.
The following is a quotation of the first paragraph of pre-AIA 35 U.S.C. 112:
The specification shall contain a written description of the invention, and of the manner and process of making and using it, in such full, clear, concise, and exact terms as to enable any person skilled in the art to which it pertains, or with which it is most nearly connected, to make and use the same, and shall set forth the best mode contemplated by the inventor of carrying out his invention.
Claims 7 and 9 are rejected under 35 U.S.C. 112(a) or 35 U.S.C. 112 (pre-AIA ), first paragraph, as failing to comply with the written description requirement. The claim(s) contains subject matter which was not described in the specification in such a way as to reasonably convey to one skilled in the relevant art that the inventor or a joint inventor, or for applications subject to pre-AIA 35 U.S.C. 112, the inventor(s), at the time the application was filed, had possession of the claimed invention.
The specification and drawings do not disclose the second dummy pattern part overlaps in the thickness direction with at least one of a second conductive pattern part disposed closest to the third edge and a second conductive pattern part disposed closest to the fourth edge among the plurality of second conductive pattern parts, as recited in claim 7.
The specification and drawings do not disclose the second dummy pattern part overlaps in the thickness direction with each of a second conductive pattern part disposed closest to the third edge and a second conductive pattern part disposed closest to the fourth edge among the plurality of second conductive pattern parts, as recited in claim 9.
Claim Rejections - 35 USC § 112

Double Patenting
The nonstatutory double patenting rejection is based on a judicially created doctrine grounded in public policy (a policy reflected in the statute) so as to prevent the unjustified or improper timewise extension of the “right to exclude” granted by a patent and to prevent possible harassment by multiple assignees. A nonstatutory double patenting rejection is appropriate where the conflicting claims are not identical, but at least one examined application claim is not patentably distinct from the reference claim(s) because the examined application claim is either anticipated by, or would have been obvious over, the reference claim(s). See, e.g., In re Berg, 140 F.3d 1428, 46 USPQ2d 1226 (Fed. Cir. 1998); In re Goodman, 11 F.3d 1046, 29 USPQ2d 2010 (Fed. Cir. 1993); In re Longi, 759 F.2d 887, 225 USPQ 645 (Fed. Cir. 1985); In re Van Ornum, 686 F.2d 937, 214 USPQ 761 (CCPA 1982); In re Vogel, 422 F.2d 438, 164 USPQ 619 (CCPA 1970); In re Thorington, 418 F.2d 528, 163 USPQ 644 (CCPA 1969).
A timely filed terminal disclaimer in compliance with 37 CFR 1.321(c) or 1.321(d) may be used to overcome an actual or provisional rejection based on nonstatutory double patenting provided the reference application or patent either is shown to be commonly owned with the examined application, or claims an invention made as a result of activities undertaken within the scope of a joint research agreement. See MPEP § 717.02 for applications subject to examination under the first inventor to file provisions of the AIA as explained in MPEP § 2159. See MPEP § 2146 et seq. for applications not subject to examination under the first inventor to file provisions of the AIA . A terminal disclaimer must be signed in compliance with 37 CFR 1.321(b).
The filing of a terminal disclaimer by itself is not a complete reply to a nonstatutory double patenting (NSDP) rejection. A complete reply requires that the terminal disclaimer be accompanied by a reply requesting reconsideration of the prior Office action. Even where the NSDP rejection is provisional the reply must be complete. See MPEP § 804, subsection I.B.1. For a reply to a non-final Office action, see 37 CFR 1.111(a). For a reply to final Office action, see 37 CFR 1.113(c). A request for reconsideration while not provided for in 37 CFR 1.113(c) may be filed after final for consideration. See MPEP §§ 706.07(e) and 714.13.
The USPTO Internet website contains terminal disclaimer forms which may be used. Please visit www.uspto.gov/patent/patents-forms. The actual filing date of the application in which the form is filed determines what form (e.g., PTO/SB/25, PTO/SB/26, PTO/AIA /25, or PTO/AIA /26) should be used. A web-based eTerminal Disclaimer may be filled out completely online using web-screens. An eTerminal Disclaimer that meets all requirements is auto-processed and approved immediately upon submission. For more information about eTerminal Disclaimers, refer to www.uspto.gov/patents/apply/applying-online/eterminal-disclaimer.
Claims 16-19 are rejected on the ground of nonstatutory double patenting as being unpatentable over claims 11-12, 15-16, and 18 of U.S. Patent No. 11,694,964 in view of Takahashi (US 2009/0016030).
Instant Application 18/790342
U.S. Patent No. 11,694,964
Claim 16. A chip package comprising:
a flexible circuit board, and
wherein the flexible circuit board comprises:
a substrate including first and second surfaces opposite to each other in a thickness direction, and first and second sides opposite to each other in a width direction;
a plurality of first conductive pattern parts disposed on the first surface of the substrate;
a plurality of second conductive pattern parts disposed under the second surface of the substrate;
at least one first dummy pattern part disposed under the second surface of the substrate in a region where the second conductive pattern part is not disposed and overlapping the first conductive pattern part in the thickness direction;
at least one second dummy pattern part disposed on the first surface of the substrate in a region where the first conductive pattern part is not disposed and overlapping the second conductive pattern part in the thickness direction;
a first protective layer disposed on the first conductive pattern part and the second dummy pattern part; and
a second protective layer disposed under the second conductive pattern part and the first dummy pattern part, and
wherein a chip is disposed on the first conductive pattern part,
wherein the first dummy pattern part overlaps in the thickness direction with at least one of a first conductive pattern part disposed closest to the first side of the substrate and a first conductive pattern part disposed closest to the second side of the substrate among the plurality of first conductive pattern parts, and
wherein the second dummy pattern part overlaps in the thickness direction with at least one of a second conductive pattern part disposed closest to the first side of the substrate and a second conductive pattern part disposed closest to the second side of the substrate among the plurality of second conductive pattern parts.
Claim 11. A chip package which comprises a flexible circuit board, the flexible circuit board comprising:
a substrate;
a first conductive pattern part disposed on a first surface of the substrate;
a second conductive pattern part disposed on a second surface opposite to the first surface of the substrate;
a first dummy pattern part disposed in a region of the second surface of the substrate in which the second conductive pattern part is not disposed;
a first protection layer disposed on the first conductive pattern part;
a second protection layer disposed on the second conductive pattern part and the first dummy pattern part,
a chip disposed on the first conductive pattern part or the second conductive pattern part,
wherein the first conductive pattern part at an outermost periphery of the substrate is covered by the first protection layer, and
wherein the first dummy pattern part includes: a first wiring pattern layer, and
a first plating layer including tin (Sn) disposed on the first wiring pattern layer.
Claim 12. The flexible circuit board further comprises: a second dummy pattern part which is disposed in a region of the first surface of the substrate in which the first conductive pattern part is not disposed and at least a part of which is vertically overlapped with the second conductive pattern part, wherein the second dummy pattern part includes a second wiring pattern layer, and a second plating layer including tin (Sn) disposed on the second wiring pattern layer, wherein the first conductive pattern part has the same layer structure as the second dummy pattern part, and wherein the second conductive pattern part has the same layer structure as the first dummy pattern part.
Claim 11-12 of U.S. Patent No. 11,694,964 do not disclose the first conductive pattern part and the second conductive pattern part are a plurality of first conductive pattern parts and a plurality of second conductive pattern parts. However, Takahashi discloses a flexible circuit board (10) comprising a plurality of first conductive pattern parts (5a) and a plurality of second conductive pattern parts (5b). Note Figures 1B-2 of Takahashi. Therefore, it would have been obvious to one of ordinary skills in the art at the time the invention was made to form the first conductive pattern part and the second conductive pattern part of U.S. Patent No. 11,694,964 being a plurality of first conductive pattern parts and a plurality of second conductive pattern parts, such as taught by Takahashi in order to have the desired configuration.
Further, it would have been obvious to one having ordinary skill in the art before the effective filing date of the claimed invention to form the first conductive pattern part and the second conductive pattern part being a plurality of first conductive pattern parts and a plurality of second conductive pattern parts, since it has been held that mere duplication of the essential working parts of a device involves only routine skill in the art. In re Harza, 124 USPQ 378. See MPEP 2144.04.
Regarding claim 17, as similarly describe above, Claim 15 of U.S. Patent No. 11,694,964 and Takahashi disclose the first dummy pattern part overlaps in the thickness direction with each of the first conductive pattern part disposed closest to the first side of the substrate and the first conductive pattern part disposed closest to the second side of the substrate, and wherein the second dummy pattern part overlaps in the thickness direction with each of a second conductive pattern part disposed closest to the first side of the substrate and a second conductive pattern part disposed closest to the second side of the substrate in the thickness direction
Regarding claim 18, as similarly describe above, Claim 16 of U.S. Patent No. 11,694,964 and Takahashi disclose a distance from the first side to an initial start position of the first conductive pattern part disposed closest to the first side is the same as a distance from the first side to an initial start position of the first dummy pattern part disposed closest to the first side.
Regarding claim 19, as similarly describe above, Claim 18 of U.S. Patent No. 11,694,964 and Takahashi disclose a distance from the second side to an initial start position of the second conductive pattern part disposed closest to the second side is the same as a distance from the second side to an initial start position of the second dummy pattern part disposed closest to the second side.
