The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA .
Specification
The title of the invention is not descriptive. A new title is required that is clearly indicative of the invention to which the claims are directed. The examiner proposes DISPLAY SOURCE/DRAIN ELECTRODE WITH A BEND AND A CURVED END
Note on Interpretation
Claim 1 recites that “the second conductive structure comprises a turning part and an end part”. The “turning part” is interpreted to be a part that turns, that is, has a bend.
Claim Rejections - 35 USC § 112
The following is a quotation of the first paragraph of 35 U.S.C. 112(a):
(a) IN GENERAL.—The specification shall contain a written description of the invention, and of the manner and process of making and using it, in such full, clear, concise, and exact terms as to enable any person skilled in the art to which it pertains, or with which it is most nearly connected, to make and use the same, and shall set forth the best mode contemplated by the inventor or joint inventor of carrying out the invention.
The following is a quotation of the first paragraph of pre-AIA 35 U.S.C. 112:
The specification shall contain a written description of the invention, and of the manner and process of making and using it, in such full, clear, concise, and exact terms as to enable any person skilled in the art to which it pertains, or with which it is most nearly connected, to make and use the same, and shall set forth the best mode contemplated by the inventor of carrying out his invention.
Claims 1-9 are rejected under 35 U.S.C. 112(a) or 35 U.S.C. 112 (pre-AIA ), first paragraph, because the specification, while being enabling for the source or drain electrode of a display that overlaps a gate electrode, does not reasonably provide enablement for other semiconductor devices. The specification does not enable any person skilled in the art to which it pertains, or with which it is most nearly connected, to practice the invention commensurate in scope with these claims. The present invention is directed to a source or drain electrode for a display. There is no disclosure that would support any other use.
To address the wands factors:
(A) The breadth of the claims – the claims are directed to any overlapping conductive structure with a particular shape for any semiconductor device.
(B) The nature of the invention is a source or drain electrode for a display. There is nothing that would enable such a structure for a memory device, photovoltaic cell, etc. There is no indication of what role such a structure would play in any other semiconductor device.
(C) The state of the prior art – there are similar structures known for displays, but not for other semiconductor devices.
(D) The level of one of ordinary skill - those in the art of displays would understand how to apply the invention to a display, but not to any other semiconductor device.
(E) The level of predictability in the art – there was no level of predictability in the art that would allow one in the art to apply the disclosure to other semiconductor devices.
(F) The amount of direction provided by the inventor – there is no direction provided as to how to apply this invention to other semiconductor devices.
(G) The existence of working examples – there are no working examples of other semiconductor devices.
(H) The quantity of experimentation needed to make or use the invention based on the content of the disclosure – the level of experimentation necessary would be extreme, as there are not only no examples of other semiconductor devices, but also reasons given why such a structure might possibly be used in any other semiconductor devices, so that one in the art would be casting about in the dark to apply the invention in any other context.
Allowable Subject Matter
Claim 1-9 would be allowable if rewritten or amended to overcome the rejection(s) under 35 U.S.C. 112(a), set forth in this Office action. The examiner did not find a display source/drain electrode overlapping a gate with a non-overlapping portion that has a round end and a turning (bent) part connected to the end.
