Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . Specification The title of the invention is not descriptive. A new title is required that is clearly indicative of the invention to which the claims are directed. The following title is suggested: ELECTROLUMINESCENT DISPLAY DEVICE HAVING A SUB-PIXEL WITH DUAL COLOR FILTERS Claim Rejections - 35 USC § 103 In the event the determination of the status of the application as subject to AIA 35 U.S.C. 102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory basis (i.e., changing from AIA to pre-AIA ) for the rejection will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status. The following is a quotation of 35 U.S.C. 103 which forms the basis for all obviousness rejections set forth in this Office action: A patent for a claimed invention may not be obtained, notwithstanding that the claimed invention is not identically disclosed as set forth in section 102, if the differences between the claimed invention and the prior art are such that the claimed invention as a whole would have been obvious before the effective filing date of the claimed invention to a person having ordinary skill in the art to which the claimed invention pertains. Patentability shall not be negated by the manner in which the invention was made. Claims 18 is rejected under 35 U.S.C. 103 as being unpatentable over Heo [US PGPUB 20140183471]. Regarding claim 18, Heo teaches an electroluminescent display device comprising: a plurality of subpixels including a first sub-pixel (RG sub-pixel Fig. 2C; wherein RG is considered a sub pixel due to commonly shared) having a first light emitting area (X, Para 84, Fig. 2C) and a second sub-pixel (B sub-pixel, Fig. 2C) having a second light emitting area (Y, Para 84, Fig. 2C); a first layer (241C, Fig. 2C) in each of the first sub-pixel (anode 241C1, Fig. 2C) and the second sub-pixel (241C3, Fig. 2C); a light emitting layer (244C2, Para 103) on the first electrode in each of the first sub-pixel and the second sub-pixel (Fig. 2C); a second layer (245C, Fig. 2C) on the light emitting layer (Fig. 2C); and a plurality of color filters (290C, Para 102) including a first color filter (291C/292C, Fig. 2C) corresponding to the first light emitting area (Fig. 2C) and a second color filter (293, Para 102) corresponding to the second light emitting area (Fig. 2C), wherein the first light emitting area includes a first sub-light emitting area (R, Fig. 2C) and a second sub-light emitting area (G, Fig. 2C), the first sub-light emitting area and the second sub-light emitting area emitting light of different colors (red and green respectively, Fig. 2C), and the first color filter includes a first sub-color filter (291C, Fig. 2C) corresponding to the first sub- light emitting area and a second sub-color filter (292C, Fig. 2C) corresponding to the second sub-light emitting area (Fig. 2C). In the view of the embodiment of Fig. 2C, Heo does not specifically disclose that the first layer is a first electrode and the second layer is a second electrode. Referring to other embodiments of Heo, Heo discloses that layers 241A/B/E (Para 85/100/108) are electrodes of respective embodiment and layers 245A/E are electrodes of respective embodiment (Para 79/109) –wherein the electrodes are the electrode of the light emitting element. In view of such of further teaching by Heo, it would have been obvious to a person having ordinary skills in the art before the effective filing date of the claimed invention, have the first layer and second layer in the embodiment of Fig. 2C be electrodes at least based on the rationale of using known technique to improve similar devices (methods, or products) in the same way using (MPEP 2143.I.C). Allowable Subject Matter Claims 1-17 are allowed. Claims 19-25 are objected to as being dependent upon a rejected base claim, but would be allowable if rewritten in independent form including all of the limitations of the base claim and any intervening claims. The following is a statement of reasons for the indication of allowable subject matter: Claims 1-17 are allowed because all prior arts of record and related prior arts not of record either singularly or in combination fail to anticipate or render obvious an electroluminescent display device, comprising: the cyan color filter includes a first sub-color filter corresponding to the first sub-light emitting area and a second sub-color filter corresponding to the second sub- light emitting area, and the first sub-color filter transmits a green light, and the second sub-color filter transmits a blue light (as claimed in claim 1), in combination with the rest of claim limitations as claimed and defined by the Applicant.
