Claims 17-24 are currently pending in the instant application. Applicants have amended claims 17, 18, 21 and 22 and canceled claims 1-16 and 25-31 in an amendment filed on January 6, 2025. Claims 17-22 and 24 are considered allowable and claim 23 is rejected in this Office Action.
I. Priority
The instant application is a DIV of 17/430,570, filed on August 12, 2021 PAT 12,091,392 which is a 371 of PCT/US2020/017985, filed on February 12, 2020 which claims benefit of US Provisional Application 62/805,273, filed on February 13, 2019.
II. Information Disclosure Statement
The information disclosure statement (IDS) submitted on January 6, 2025 is in compliance with the provisions of 37 CFR 1.97. Accordingly, the information disclosure statement has been considered by the examiner.
III. Rejections
Claim Rejections - 35 USC § 112
The following is a quotation of the second paragraph of 35 U.S.C. 112:
The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention.
Claim 23 is rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention. The term “enhancing” in claim 23 is a relative term which renders the claim indefinite. The term “enhancing” is not defined by the claim, the specification does not provide a standard for ascertaining the requisite degree, and one of ordinary skill in the art would not be reasonably apprised of the scope of the invention. Applicants are suggested to cancel claim 23 or amend claim 23 by deleting the term “enhancing” to overcome the rejection.
