The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA .
Status of the Claims
This action is in response to the applicant’s filing on August 27, 2024. Claims 1-15 are pending and are examined below.
Priority
Acknowledgment is made of applicant’s claim for foreign priority to European Patent No. EP 23195698.8, filed September 6, 2023.
Claim Rejections - 35 USC § 101
35 U.S.C. 101 reads as follows:
Whoever invents or discovers any new and useful process, machine, manufacture, or composition of matter, or any new and useful improvement thereof, may obtain a patent therefor, subject to the conditions and requirements of this title.
Claim 14 is rejected under 35 U.S.C. 101 because the claimed invention is directed to non-statutory subject matter.
The claim does not fall within at least one of the four categories of patent eligible subject matter because the claim is directed to a computer program product comprising program code which appears to be software per se.
Appropriate correction is required.
Allowable Subject Matter
Claims 1-13, and 15 are allowed.
Conclusion
The prior art made of record and not relied upon is considered pertinent to applicant's disclosure.
Adolfson, US 20110066336 A1, discloses receiving information regarding the weight of material to be received by a transport vehicle like a dump truck or similar heavy equipment and automatically controlling a suspension.
Suzuki et al., US 20150151600 A1, discloses lowering a vehicle height in response to identifying a user and to facilitate loading of the passenger and any baggage.
