Claim Rejections - 35 USC § 102
In the event the determination of the status of the application as subject to AIA 35 U.S.C. 102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory basis (i.e., changing from AIA to pre-AIA ) for the rejection will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status.
The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action:
A person shall be entitled to a patent unless –
(a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention.
5. Claim(s) 1 is/are rejected under 35 U.S.C. 102(a)(1) as being anticipated by Chen et al, US 2021/0368457 hereafter Chen.
As for claim 1, Chen discloses:
The method performed by a user equipment for receiving a transmission from a network node, the method comprising:
receiving an activation command activating a first Transmission Configuration Indication, TCI, codepoint with a first unified TCI state or with both a first and a second unified TCI states, and a second TCI codepoint with up to two unified TCI states (0056], [0062], Receiving the MAC-CE indicating up tp eight TCI states);
receiving a first Downlink Control Information, DCI, indicating the first TCI codepoint in a TCI field of the first DCI (figures 5-6, [0056], receiving a TCI field in downlink control information (DCI) can indicate the TCI state for the scheduled PDSCH if the time offset between the reception of the downlink DCI);
receiving a second DCI scheduling one or more Physical Downlink Shared Channels, PDSCHs, wherein there is a time offset between the end of the second DCI and the start of the one or more PDSCHs (figures 5-6, [0060], Receiving multiple PDCCHs and PDSCHs from multiple TRPs or base stations. The first DCI transmitted from a first TRP can schedule a first PDSCH transmitted from the first TRP. and second DCI transmitted from a second TRP can schedule a second PDSCH transmitted from the second TRP", [0074], Diagram 500 also includes multiple DCIs, e.g., DCI 512 and DCI 514, and multiple PDSCHs, e.g., PDSCH 522 and PDSCH 524. Further, diagram 500 includes a time offset between the DCI 512 and PDSCH 522, e.g., time offset 532, and a time offset between the DCI 514 and PDSCH 524, e.g., time offset 534. Diagram 500 also includes a QCL time duration or timeDurationforQCL. 540");
determining one or two TCI states for reception of the one or more PDSCHs based at least in part on the time offset, where the one or two TCI states are one or more of: the first unified TCI state; the second unified TCI state; both the first and the second unified TCI states (figures 5-6, [0056], determining by a TCI field in downlink control information (DCI) indicating the TCI state for the scheduled PDSCH if the time offset between the reception of the downlink DCI and the corresponding PDSCH is greater than or equal to a defined threshold, e.g., a quasi co-location (QCL) time duration or timeDurationForQC. [0062], interpretation of the TCI field of the DCI may depend on the CORESETPoolIndex value of the CORESET in which the DCI is detected. The TCI state indicated by the TCI codepoint in the DCI may be used when a scheduling offset is larger than the threshold timeDurationForQCL"); and
receiving the one or more PDSCHs according to the determined TCI state or states ([0060] receive multiple PDCCHs and PDSCHs from multiple TRPs or base stations. [0135] PDSCH corresponds to the one of the first set of TCI states indicated by the first DCI.)
Conclusion

The prior art made of record and not relied upon is considered pertinent to applicant's disclosure: US 2021/0136802 discloses [0256] The wireless device may receive the TB in the first PDSCH transmission occasion 1916 based on (e.g., using, applying, and/or with) the first TCI state, for example, based on the determining that the time offset 1908 between the reception of the DCI 1904 and the reception of the TB is equal to or greater than the threshold 1912.
