The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA .
Claim Rejections - 35 USC § 102
In the event the determination of the status of the application as subject to AIA 35 U.S.C. 102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory basis (i.e., changing from AIA to pre-AIA ) for the rejection will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status.
The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action:
A person shall be entitled to a patent unless –
(a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention.
(a)(2) the claimed invention was described in a patent issued under section 151, or in an application for patent published or deemed published under section 122(b), in which the patent or application, as the case may be, names another inventor and was effectively filed before the effective filing date of the claimed invention.
Claim(s) 1-4, 6, 9, 10, 12, and 17 is/are rejected under 35 U.S.C. 102(a)(1) as being anticipated by US 20210107792 A1 (Nandwana).
Nandwana discloses an ink ([0044]), comprising: a two-dimensional ([0024]) WS2 ([0028]) nanosheet ([0024]): and a solvent ([0046]) [claim 1], wherein the solvent is an organic solvent ([0046]) [claim 2], wherein the solvent is water ([0046]) [claim 3], wherein the ink is at or below 200C ([0066]) [claim 4].
Additionally, Nandwana discloses an electronic circuit ([0004]), comprising: a substrate ([0044]); and ink according to claim 1 (as described above) deposited on a first surface of the substrate to form a pattern ([0044]) [claim 6], wherein the substrate is flexible ([0044]) [claim 9], wherein the electronic circuit is at or below 20 0C ([0066]) [claim 10].
Similarly, Nandwana discloses a method for forming a device, comprising: providing an ink according to claim 1 (as described above); and depositing the ink onto a first surface of a substrate ([0044]) [claim 12].
Moreover, Nandwana discloses an ink cartridge, comprising: an ink according to claim 1 (as described above); and a housing configured to hold the ink ([0066]) [claim 17].
Allowable Subject Matter
Claims 18 and 19 are allowed.
Claims 5, 7, 8, 11, and 13-16 are objected to as being dependent upon a rejected base claim, but would be allowable if rewritten in independent form including all of the limitations of the base claim and any intervening claims.
The following is a statement of reasons for the indication of allowable subject matter: Claim 5 states the limitation “wherein the ink is at or below 7.3 K.” This limitation, in conjunction with the other claimed features, was neither found to be disclosed in, nor suggested by the prior art. Claim 7 states the limitation “wherein the pattern comprises a superconducting qubit.” This limitation, in conjunction with the other claimed features, was neither found to be disclosed in, nor suggested by the prior art. Claim 8 states the limitation “wherein the pattern comprises a first portion that is a superconducting portion, and a second portion that has been treated to form a semiconducting portion.” This limitation, in conjunction with the other claimed features, was neither found to be disclosed in, nor suggested by the prior art. Claim 11 states the limitation “wherein the electronic circuit is at or below 7.3 K.” This limitation, in conjunction with the other claimed features, was neither found to be disclosed in, nor suggested by the prior art. Claims 13-16 state the limitation “further comprising treating a portion of the ink to form a semiconducting portion.” This limitation, in conjunction with the other claimed features, was neither found to be disclosed in, nor suggested by the prior art. Claims 18 and 19 state the limitation “forming the water-based ink by centrifuging the WS2-water suspension at a second speed, the second speed being less than the first speed, and utilizing an upper portion of a resulting suspension.” This limitation, in conjunction with the other claimed features, was neither found to be disclosed in, nor suggested by the prior art.
