Notice of Pre-AIA or AIA Status
The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA .
The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action:
A person shall be entitled to a patent unless –
(a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention.
Claims 25-38 are rejected under 35 U.S.C. 102(a1) as being anticipated by Vintola et al. (2022/124666).
For independent claim 25, Vintola et al. discloses
an apparatus, comprising: at least one processor; and at least one memory including computer program code; the at least one memory and the computer program code (e.g. Fig. 1 and Fig. 2 and their resp. description in combination with the passages mentioned below) configured to cause the apparatus at least to:
receive, by a user device in a wireless network from a network node in the wireless network, a request to provide a location of an uplink direct current subcarrier, the request identifying a criterion for which the user device is to exclude the location of the uplink direct current subcarrier in a report to the network node
(Para 43: impractical combinations of BWPs for the configured CCs in the channel bandwidth may be excluded from DC location reporting. "; here: NW informs UE, i.e. its "requests" to exclude DC reporting for (certain) CCs (" a network may inform a UE computing device of combinations of possible activated BWPs and DC locations associated with only the network indicated possible activated BWPs may be reported by a UE computing device;
Para 46 : Here, DC location Reporting activated only for a part of CCs: "The UE computing device may determine DC locations only for the indicated BWP permutations that will be activated across the configured CCs for the channel bandwidth. The UE computing device may report only DC locations for the indicated BWP permutations that will be activated across the configured CCs for the channel bandwidth".
- Para 47 explicitly disclose that the BS requests the DC location reporting only for some CCs, i.e. the other CCs are excluded from reporting ("...may request the UE computing device indicate DC locations based only those edge most CC BWP permutations.")
- Paras 117 and 124 also disclose the request of the DC location reporting for only a part of the BWPs/CCs (i.e. the remaining ones are excluded).).
For independent claims 31 and 32 are rejected for the same reason as claim 25.
For dependent claims 26-31 and 33-38, Vintola et al. also discloses :
wherein the criterion includes whether an operating frequency range includes a specific frequency range(see in particular Paras 40-51 and 90-139;
wherein the criterion includes whether an operating frequency range is outside of a frequency range of a current serving cell (see in particular Paras 40-51 and 90-139);
wherein the criterion includes whether an operating frequency range is outside of a specific frequency range(see in particular Paras 40-51 and 90-139);
wherein each of a set of carrier components covers a respective component frequency range, and wherein the request includes identifiers for each of the set of carrier components(see in particular Paras 40-51 and 90-139);
wherein the identifiers include respective reference numbers for each of the set of carrier components(see in particular Paras 40-51 and 90-139);
wherein the at least one memory and the computer program code are further configured to cause the apparatus at least to: receiving, from a user device of the set of user devices, (i) a report indicating a reference number for a carrier component of the set of carrier components and (ii) a location of the uplink direct current subcarrier within the carrier component; and determining the location of the uplink direct current subcarrier based on the reference number and the location of the uplink direct current subcarrier within the carrier component. (see in particular Paras 40-51 and 90-139); and
wherein a default location for the uplink direct current subcarrier is in a center of a UE frequency range that has a minimum frequency at a lowest frequency of a first carrier component of the set of carrier components and a maximum frequency of a second carrier component of the set of carrier components, each of the first and second carrier components being one of an activated carrier component, a configured carrier component, or an activated BWP and configured BWP; and wherein determining the location of the uplink direct current subcarrier includes specifying an offset of the default location of the uplink direct current subcarrier. (see in particular Paras 40-51 and 90-139).
The prior art made of record and not relied upon is considered pertinent to applicant's disclosure.
Li et al. (2026/0143427) is cited to show a system which is considered pertinent to the claimed invention.
