DETAILED ACTION Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . Claims 1-20 have been examined. Claim Rejections - 35 USC § 101 35 U.S.C. 101 reads as follows: Whoever invents or discovers any new and useful process, machine, manufacture, or composition of matter, or any new and useful improvement thereof, may obtain a patent therefor, subject to the conditions and requirements of this title. Claims 10 and 11 are rejected under 35 U.S.C. 101 because the claimed invention is directed to non-statutory subject matter. The claim(s) does/do not fall within at least one of the four categories of patent eligible subject matter. In reference to claim 10 Claim 10 is directed to a “computer program”, which does not constitute statutory subject matter such as a process, machine, article of manufacture or composition of matter. In reference to claim 11 The broadest reasonable interpretation of a claim drawn to a "computer readable medium" typically covers non-transitory tangible media and transitory propagating signals per se in view of the ordinary and customary meaning of the term "computer-readable medium", particularly when the specification is silent. In the instant case, the specification fails to define the term "computer readable medium". Therefore, the broadest reasonable interpretation of the term "computer readable medium" includes transitory propagating signals per se. Hence, claim 11 is rejected as being directed to non-statutory subject matter, i.e. transitory propagating signals per se. The Examiner recommends overcoming the above rejection by amending "computer readable medium" to --non-transitory computer readable medium--. Allowable Subject Matter Claims 1-9 and 12-20 are allowed. Conclusion The prior art made of record and not relied upon is considered pertinent to applicant's disclosure are: US 2021/0212051 pertains to a user equipment (UE) may receive configuration information from a base station that indicates a set of resources for the UE to establish sidelink communications with another UE in a wireless network. The UE may transmit a first set of reference signals using a first set of beams to determine a set of neighboring candidate UEs for a sidelink connection. The UE may then transmit a second set of reference signals on a second set of beams to the neighboring candidate UEs, and may select a second UE located in the determined neighboring set using various beam scanning procedures. US 2020/0343951 pertains to an electronic device for wireless communication comprises a processing circuit, wherein the processing circuit is configured to conduct control so as to send a reference signal for a direct link to the other user equipment or to receive same from the other user equipment; the processing circuit is also configured to conduct control so as to carry out beamforming-based direct link communication with the other user equipment; and at least one of a sending beam and a receiving beam for direct link communication is determined based on the measurement of the reference signal. US 10264396 pertains to a method of distance measurement for a first wireless communication device of a wireless communication system includes receiving a frame from a second wireless communication device of the wireless communications system; determining a signal strength of the received frame; and obtaining a round trip time (RTT) and estimating a distance between the first wireless communication device and the second wireless communication device according to the signal strength of the received frame.
