Office Action

§112
Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . Claim Rejections - 35 USC § 112 The following is a quotation of 35 U.S.C. 112(b): (b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention. The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph: The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention. Claim(s) 1-27 is/are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor, or for pre-AIA the applicant regards as the invention. Claim 1 recites the limitation "predefined number boluses" in line 14,15, which appears to be an error. For examination, it is assumed to mean “predefined number of boluses”. Allowable Subject Matter Claim(s) 29, 30 is/are allowed. Claim(s) 1-27 would be allowable if rewritten or amended to overcome the rejection(s) under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), 2nd paragraph, set forth in this Office action. The following is a statement of reasons for the indication of allowable subject matter: The prior fails to disclose a sequence of time-separated boluses for a target temperature of the fluid in the non-heated reservoir in combination with other limitations of claims 1 or 29. Closest prior art Pouchoulin et al (20190160216) discloses a dialysis system with a heater 13 but fails to disclose sequence of time-separated boluses for a target temperature. Related prior art Kammerzell et al (20220249751) discloses a dialysis system but fails to disclose temperature controller 15,151 and a temperature bolus (Para 8) but fails to disclose sequence of time-separated boluses for a target temperature of a reservoir. Related prior art Zhang et al (20110004141) discloses producing a temperature bolus (Para 24) for temperature control but fails to disclose sequence of time-separated boluses for a target temperature of a reservoir.
