Claim Rejections - 35 USC § 101
35 U.S.C. 101 reads as follows:
Whoever invents or discovers any new and useful process, machine, manufacture, or composition of matter, or any new and useful improvement thereof, may obtain a patent therefor, subject to the conditions and requirements of this title.
Claim 33 is rejected under 35 U.S.C. 101 because the claimed invention is directed to non-statutory subject matter. The claim(s) does/do not fall within at least one of the four categories of patent eligible subject matter because the claimed invention is directed to non-statutory subject matter. The claim(s) does/do not fall within at least one of the four categories of patent eligible subject matter because; the claimed invention is directed to computer program per se, which is non-statutory. See MPEP 2106(I). A claim directed toward a computer-readable medium having the program encoded thereon establishes a sufficient functional relationship between the program and a computer so as to remove it from the realm of “program per se”. MPEP 2111.05(III). Hence, adding the limitation of “stored on a non-transitory computer-readable medium” would resolve this issue.
Allowable Subject Matter
Claims 1-19 are allowed.
The prior art(s) cited by the Examiner and/or the Applicant fails, singularly or in combination, to teach or suggest the following limitations indicated in independent claims 1 and 17:
“
receive data and reference signals;
determine a channel estimate for the received data based on the reference
signals; and
equalize the received data with a sequential plurality of equalization stages,
one or more of the sequential plurality of equalization stages comprising:
an equalizer configured to determine an equalized representation of input
data based a previous channel estimate, and
a neural network configured to determine at least a refined channel estimate
for a subsequent equalization stage based on the previous channel estimate and the
input data.
”
Conclusion
The prior art made of record and not relied upon is considered pertinent to applicant's disclosure.
US 10,567,200 B2 relates to the field of signal processing to reduce the time taken for channel estimation.
US 2005/0141657 A1 teaches a data transmission rate to be adjusted based upon a detected transmission condition.
