Office Action

§101
DETAILED ACTION Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . Claim Rejections - 35 USC § 101 35 U.S.C. 101 reads as follows: Whoever invents or discovers any new and useful process, machine, manufacture, or composition of matter, or any new and useful improvement thereof, may obtain a patent therefor, subject to the conditions and requirements of this title. Claim 19 is rejected under 35 U.S.C. 101 because the claimed invention is directed to an abstract idea without significantly more. The claim recites a computer program product comprising instructions. This judicial exception is not integrated into a practical application because the computer program is neither recorded on a non-transitory computer readable medium nor explicitly executed by a computer device. The claim does not include additional elements that are sufficient to amount to significantly more than the judicial exception because there is no functional relationship between the computer program and a computer device. Allowable Subject Matter Claims 1-21 are allowable over the prior art. The claims are directed towards a radio receiver that adjusts for distortion in a radio signal using a machine learning algorithm to perform both frequency domain and time domain processing to determine the log likelihood ratio of information bits (i.e. symbol detection). Similar prior art which performs symbol detection (see for example Kons 2024/0195660) does not teach or reasonably suggest applicant’s claimed invention of a combined time/frequency domain processing process with a machine learning model at the time of effective filing.
