DETAILED ACTION Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . Claim Rejections - 35 USC § 112 The following is a quotation of 35 U.S.C. 112(b): (b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention. The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph: The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention. Claims 16-21 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention. Claim 16 recites “the adhesive composition of claim 13.” Claim 13 is directed toward an adhesive sheet. Claim 9 is directed toward an adhesive composition, and claim 16 could be amended to recite –the adhesive composition of claim 9.— Claim 17 recites “the adhesive composition of claim 13.” Claim 13 is directed toward an adhesive sheet. Claim 9 is directed toward an adhesive composition, and claim 17 could be amended to recite –the adhesive composition of claim 9.— Claims 18-21 incorporate the indefinite language of a base claim, and are rejected for the same reasons as the base claim. Claim 20 recites the limitation "the window material according to claim 17" in line 1. There is insufficient antecedent basis for this limitation in the claim. Claim 17 is directed toward “a light-transparent roof material.” Claim 20 could be amended to recite –the light-transparent roof material according to claim 17.-- Claim 21 recites the limitation "the window material according to claim 17" in line 1. There is insufficient antecedent basis for this limitation in the claim. Claim 17 is directed toward “a light-transparent roof material.” Claim 20 could be amended to recite –the light-transparent roof material according to claim 17.-- Allowable Subject Matter Claims 1-15 are allowed. Claims 16-21 would be allowable if rewritten or amended to overcome the rejection(s) under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), 2nd paragraph, set forth in this Office action. The following is a statement of reasons for the indication of allowable subject matter: the prior art fails to anticipate, teach, suggest or otherwise render obvious each and every element of the claims. Independent claim 9 discloses an adhesive comprising 1-100 parts by mass of polymer fine particles with respect to 100 parts by mass of a temperature-sensitive adhesive agent, and the claim recites specifics for a refractive index increasing rate and an adhesive force reduction rate. Satake [JP2002-212526] discloses an adhesive composition having an acrylic polymer and fine particles. Satake fails to disclose the claimed specifics of the refractive index increasing rate, and the adhesive force reduction rate. Yamaguchi [EP4502334] discloses a window and roof material that includes an adhesive layer comprising an adhesive agent and fine particles. Yamaguchi fails to disclose the claimed specifics of the refractive index increasing rate, and the adhesive force reduction rate.
