Office Action

§112
DETAILED ACTION Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . Claim Rejections - 35 USC § 112 The following is a quotation of 35 U.S.C. 112(b): (b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention. The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph: The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention. Claims 1-14 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention. Claims 1-14 are generally narrative and indefinite, failing to conform with current U.S. practice. They appear to be a literal translation into English from a foreign document and are replete with grammatical and idiomatic errors. As non-limiting examples, claim 1 recites “, the heat exchanger,” (line 2) which renders claims 1-14 indefinite. Similarly, as a non-limiting example, claim 1 recites “on the one hand…on the other hand” which renders claims 1-14 indefinite. Similarly, as a non-limiting example, regarding at least claim 1, the phrase "in particular" renders the claim indefinite because it is unclear whether the limitation(s) following the phrase are part of the claimed invention. See MPEP § 2173.05(d). Similarly, as a non-limiting example, claims 7, 9-10 recite “wherein it” which renders claims 7, 9-10 indefinite. Allowable Subject Matter Claims 1-14 would be allowable if rewritten to overcome the rejection(s) under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), 2nd paragraph, set forth in this Office action and to include all of the limitations of the base claim and any intervening claims. Regarding claims 1-14, Nakamura, Huggins, Thomas, Schnabel, Bergman teach heat exchangers for turbomachines comprising annular panels and a plurality of fins… wherein said fins increase radially between an inner cylindrical surface and an outer cylindrical surface but do not teach wherein said fins are arranged in a plurality of rows along a longitudinal axis and are arranged in a staggered configuration, each row being parallel to each other and connected to each other.
