Claim Rejections - 35 USC § 103
In the event the determination of the status of the application as subject to AIA 35 U.S.C. 102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory basis for the rejection will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status
The following is a quotation of 35 U.S.C. 103 which forms the basis for all obviousness rejections set forth in this Office action:
A patent for a claimed invention may not be obtained, notwithstanding that the claimed invention is not identically disclosed as set forth in section 102 of this title, if the differences between the claimed invention and the prior art are such that the claimed invention as a whole would have been obvious before the effective filing date of the claimed invention to a person having ordinary skill in the art to which the claimed invention pertains. Patentability shall not be negated by the manner in which the invention was made.
Claims 1 and 19 are rejected under 35 U.S.C. 103 as being unpatentable over U.S. PGPub. No. 20230085960 to Caglayan et al. in further view of U.S. PAT. No. 11734538 to Frankel et al.
As to Claim 1, Caglayan discloses a terminal device, comprising (Fig. 3, Fig. 4, paragraph [0008], wireless power transmitter/receiver):
a first circuitry coupled to an antenna and configured for modulation based on the dual frequency signal received via the antenna, wherein a first frequency part of the dual frequency signal matches the antenna resonance frequency and is used for charging an energy storage of the termina device, and a second frequency part of the dual frequency is used for performing the modulation at a mismatched frequency of an antenna impedance (Fig. 3, Fig. 4, paragraph [0029, 0038, 0039, 0043, 0044, 0045], where the dual band (different frequency band) is used for the power transfer and harvesting/charging the power from one band (matched with specific frequency) through the power harvesting circuit (first circuit - diode and capacitor to resonant at specific frequency) and modulating backscatter signal through the switch for other band (unmatched frequency to the antenna resonance/impedance for power harvesting)).
a second circuitry coupled to the first circuitry and configure to control a state of the first circuitry for performing modulation (Fig. 3, Fig. 4, paragraph [0029, 0038, 0039, 0043, 0044, 0045], where the control circuit/MCU (second circuit) controls the modulation connected through the power harvesting circuit (first circuit - diode and capacitor to resonant at specific frequency)).
Caglayan disclose all of the subject matter as described above (Fig. 3, Fig. 4, paragraph [0029, 0038, 0039, 0043, 0044, 0045]) except for the BPSK modulation.
However, it is well known in art to apply various modulation schemes for date rate and different channel environment. Also Frankel in the same field of endeavor teaches the dual band transceiver for harvesting the power and modulating various types including phase-shift keying, frequency shift keying, amplitude modulation, amplitude shift keying, on-off keying, quadrature amplitude modulation, Gaussian frequency shift keying, continuous phase modulation, etc. which implicitly includes the BPSK (Fig. 2, Col. 4 line 43-58, Col. 5 lines 18-21, Col. 14 lines 31-44, Col. 15 lines 11-22).
Therefore, it would have been obvious to one of ordinarily skilled in the art before the effective filing date of the claimed invention to use BSPK modulation as taught by Frankel to modify the device of Caglayan to enhance the communication device supporting various types of modulation schemes (Frankel – Col. 21 lines 27-35).
As to Claim 19, Caglayan in view of Frankel discloses the terminal device where in the antenna is a single resonance antenna (Caglayan - Fig. 3, Fig. 4, paragraph [0038], having single antenna for power harvesting)(Frankel - Fig. 2, Col. 5 lines 18-21, single antenna is used for dual-band power harvesting transceivers).
Allowable Subject Matter
Claims 2-18 are objected to as being dependent upon a rejected base claim, but would be allowable if rewritten in independent form including all of the limitations of the base claim and any intervening claims.
The following is a statement of reasons for the indication of allowable subject matter: the prior art of record fail to anticipate or render obvious step of the third circuitry coupled to the antenna and configured for an on-off-key (OOK) modulation based on a single frequency signal received via the antenna resonance frequency, wherein the second circuitry is coupled to the third circuitry and configured to control a state of the third circuitry for performing the OOK modulation.
