The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA .
Claim Rejections - 35 USC § 112(b)
The following is a quotation of 35 U.S.C. 112(b):
(b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention.
The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph:
The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention.
Claims 9-26 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor, or for pre-AIA the applicant regards as the invention. Independent claims 9 and 18 recite “determining a light marking projection based on the structure border, wherein the light marking projection comprises a marking border that is a negative of the structure border”. It is not clear what a negative of the structure border is or what it means to be a negative border. The specification is not clear on how this is derived. Furthermore, based on the drawings, it appears that the structure and the marking share the same border.
Dependent claims 14 and 23 recite “determine an accuracy-of-fit between the marking border and the structure border”. It is not clear what the accuracy of fit is referring or what is being measured.
