Double Patenting 08-33 The nonstatutory double patenting rejection is based on a judicially created doctrine grounded in public policy (a policy reflected in the statute) so as to prevent the unjustified or improper timewise extension of the “right to exclude” granted by a patent and to prevent possible harassment by multiple assignees. A nonstatutory double patenting rejection is appropriate where the claims at issue are not identical, but at least one examined application claim is not patentably distinct from the reference claim(s) because the examined application claim is either anticipated by, or would have been obvious over, the reference claim(s). A timely filed terminal disclaimer in compliance with 37 CFR 1.321(c) or 1.321(d) may be used to overcome an actual or provisional rejection based on a nonstatutory double patenting ground provided the reference application or patent either is shown to be commonly owned with this application, or claims an invention made as a result of activities undertaken within the scope of a joint research agreement. Current Application # 18915265 US Pat # 12142334 For example: Claim 2: A memory device comprising: a content addressable memory (CAM) block storing a plurality of stored search keys; and control logic, operatively coupled with the CAM block, to perform operations comprising: determining a calculated parity value representing a first number of memory cells in at least one string of the CAM block storing a first logical value ; comparing the calculated parity value to stored parity data from the CAM block; and responsive to determining that the calculated parity value does not match the stored parity data, determining that an error is present in one of the plurality of stored search keys stored on the at least one string in the CAM block. For example: Claim 1: A memory device comprising: a content addressable memory (CAM) block storing a plurality of stored search keys; and control logic, operatively coupled with the CAM block, to perform operations comprising: reading one of the plurality of stored search keys from at least one string of the CAM block to determine a first number of memory cells in the at least one string storing a first logical value; determining a calculated parity value representing the first number of memory cells in the at least one string storing the first logical value ; storing the calculated parity value in a page cache associated with the CAM block; reading stored parity data from one or more memory cells in the at least one string in the CAM block, the one or more memory cells connected to one or more additional wordlines in the CAM block; and comparing the calculated parity value to the stored parity data to determine whether an error is present in the one of the plurality of stored search keys in the CAM block. Even though the claims at issue are not identical but overall scope of the claims are identical and they are not patentably distinct from each other.. Claims 2-21 would be allowable if the double patenting rejection set forth in this office action is overcome.
